RE: SUB 03-017 Indian Springs (Herring) Preliminary Subdivision Plat
Dear Mr. Powell:
Your request for authorization to construct a private road was approved by the Planning Commission on
its April 8,2003 consent agenda with the following conditions:
1. The private road shall be the sole means of access to the Residue and Tax Map 18, Parcel 33A.
2. The subdivider shall submit a maintenance agreement that satisfies the requirements of section 14-
313.
3. The final plat shall contain the statement required by section 14-303(N).
4. The surveyor shall certify on the plat that the existing and/or proposed right-of-way is of adequate
width and horizontal and vertical alignment to accommodate a travelway passable by ordinary
passenger vehicles in all but temporary extreme weather conditions,together with area adequate for
maintenance of such travelway. Such certification may be accomplished by the following wording on
the plat: "This private road will provide reasonable access by motor vehicle as required by § 14-514
of the Albemarle County Code." [14-514 (table A)]
Your preliminary plat has also been administratively approved on this date. The approval of the
preliminary plat is valid for(1)one year in accordance with Section 14-228 of the Subdivision Ordinance.
All final plats must be submitted to the Department of Planning and Community Development while the
preliminary plat is still valid. If the preliminary plat approval expires, a new application must be filed and
processed.
Final plats will be subject to all final plat requirements (Subdivision Ordinance Section 14-303), in
addition to the following conditions: [The following conditions must be met prior to final approval.]
Planning approval to include:
1. [14-302(E)] Vicinity sketch. A sketch showing the property and its relationship with adjoining land
and streets, its relationship with landmarks in the area and, if the subdivision is a phased subdivision,
all other phases of the subdivision for which a final plat has been approved, in detail adequate to
describe location of the property without field review.

- Show all approved Indian Springs 'phases" with roads. Show the roads through Phase 1.
2. [14-302(F)] Existing or platted streets, easements and natural streams. The location, width and names
of all existing or platted streets, easements and natural streams, and all other rights-of-way and
easements.
- Show and label the r-o-w width of the road coming from the original Indian Springs subdivision.

Engineering approval to include:
1. The subdivider shall submit prior or with the final plat, all previously approved plans for public
streets, drainage courses, drainage control, erosion and sedimentation control measures, and
stormwater management. [14-312]
2. Please dimension the location of the proposed drainage easement. Please dimension by reference to
property corners,by centerline bearings, or by metes and bounds so the easement can be physically
located in the field should drainage conditions change. [Policy]
3. We recommend that the Structure C2 be removed from the final plat. The structure is not required on
the final plat.
4. All improvements must be built or bonded prior to approval of final plats.
The following items must be reviewed and approved by the Engineering Department before tentative
approval of the final plat can be granted. A completed submittal form and application, available at the
Engineering Department, must accompany all submittals. The required number of copies and the required
fees are indicated on the form and application.
A. An erosion control plan, narrative and computations. [18-32.7.4.3, 17-203]
B. A completed application and fee for erosion control and stormwater management. [17-203, 17-303]
C. A stormwater management/BMP plan and computations. Computations must include water quality
and detention routings for the 2yr and l 0yr storms. [17-304]
D. A completed stormwater management facilities maintenance agreement and fee. [17-323]
E. Road plans, pavement design sheets, and drainage computations. [14-512, 14-304, Policy]
VDOT approval will also be required for final site plans and computations must accompany site plan
submittals.

Zoning approval to include:
1. [10.4] Revise the side setback to indicate 25 feet and the rear setback to 35 feet.
2. [10.3.1] The aggregate acreage of the four development lots on this plat is 30.9954 acres. This section
limits the acreage of the development lots to a total of 31 acres. In order to utilize the fifth
development right associated with this property that is assigned to parcel 34 it will be necessary to
reduce the total acreage of the Lots 34, 35, 38, and 39 to a maximum of 29 acres.
3. [10.3.2] Note on the plat that parcel 36 is assigned 1 development right and note the maximum size of
the potential lot based on Section 10.3.1.

1. The proposed roads in the subdivision must have approved road names labeled on the final subdivision
plat.
The applicant should develop a list of several potential names prior to contacting our office for road name
approval. This will increase the likelihood that some of the road names on the list are approvable.
