RE: Belvedere Special Exception #
Dear Cameron:
This special exception application is specific to Belvedere NMD Blocks 8 and 10 and
consists of two requests. The first request addresses a shift in an open space connection in
Phase 3, Block 10. The second addresses a shift in density allowing the current maximum
density to be placed in either Block 8 and 10. In support of this request, I offer the
following justifications.
Phase 3, Block 10 Open Space Shift
Exhibit SC in the COD identifies open space connection between the perimeter open space
and the loop. This area is highlighted in yellow in Figure 1. Our request is to shift this area
southward to the area highlighted in orange.
The original space was a graded open space and provided a pedestrian connection between
the perimeter trail and the street -side pedestrian network The proposal maintains the
location of the pedestrian connection, but shifts the open space to serve as a break between
the attached and single family detached units. Additionally, the open space shift was made
to align the space with the secondary connection required between the adjacent parcel
outside the NMD and Block 10. See Figure 2.

Tables 1 & 2 of the Belvedere COD establish the maximum and minimum units in each
block. The current maximums/minimums in Blocks 8 and 10 are 69/42 and 62/50
respectively. A separate SE Application is under review which allows for all residential
uses, except multifamily/apartments, in Blocks 8 and 10.
As originally set up, the COD established the maximum density in each block. These
densities were based on the development cap for the project. The requested flexibility
within the regulating block layout was provided such that:

The residential unit count and densities are shown on the following Tables 1 and 2.
The residential units shown below may be adjusted by block and unit type, however
the total maximum number of units shall not exceed 775. The lotting pattern as shown
on the Development Plan generally indicates this total number of residential units.
Included in these computations are accessory units or carriage house units. (p, 5)
At the time of final engineering and architectural plan preparation, it is recognized
that decisions may need to be made that would modify the exactgeometry of
individual blocks. As such, flexibility in the Code of Development is provided to permit
the boundary and acreage of exact blocks to be increased or decreased at the site plan
or subdivision stage by an amount not to exceed 15% of thegross land area of the
larger block impacted by each such change. (p. 6)
The request is consistent with this flexibility.
