A copy of the checklist you submitted is attached. The missing items have been circled with our remarks. For your convenience the applicable ordinance sections have been given on the checklist for each item, and the following ordinance section is referenced for denial of development applications: • Subdivision Ordinance, Section 14-302 for preliminary plats Specific missing elements include: • The stream buffer. (14-305, 17-317) • Flood limits. (14-308 A - this section of the ordinance applies because the drainage area is more than 50 acres, although this area may not have FEMA floodplain) • Conceptual BMP and drainage plans. (14-304, 14-305, 14-306) Please note that the preliminary BMP computation should be included. Note further that if the intent is to use the pond, it is owned by another party-the Willow Lake HOA(manager, Mitchell Toms)- and they are concerned about damage to the pond. A letter of permission will be required from the owners. This may be critical, as the plan does not appear to leave room for any erosion control protection, or stormwater management, above the pond. • Off-site topography for the pond, stream, etc. (14-302 T) • Whether the road requested is public or private. If private, provide justification. (14-505 E) • Areas of open space(14-302 H) • The vicinity sketch should show the relation to immediately surrounding areas. How far is the route 20 intersection to the east of the proposed entrance? What are the sight distances? (14-302 E, F) • Existing and departing lot lines, proposed lots, and building sites on proposed lots. Similar line weights and lines without connection to other lines make it impossible to distinguish lot lines, setbacks, topography, and possibly even, proposed grading. (14-L, M,N) Since the last critical slopes waiver in relation to this development was approved 15 years ago, and because critical slopes cover over 70%of the land to be subdivided,the County will have to review the appropriateness of any critical slopes waivers requested in 1999. Having seen the area for which these townhouses are proposed and being aware of persistent drainage problems in this area,I would recommend that we meet to discuss the appropriateness of any critical slopes waivers prior to your resubmittal. The denial of this subdivision plat is taken in accordance with Section 14-216(b) of the Subdivision Ordinance for plats You may obtain reinstatment of review as provided by Section 14-216(c)of the Subdivision Ordinance.
