Box 7546 NELSON COUNTY(LOVINGSTON) Fax (434)972-4310 Charlottesville, Virginia 22906 April 16,2012 Joanne Tu Purtsezova,Planner Department of Community Development 401 McIntire Road,Room 227 Charlottesville,Virginia 22902-4596 RE: Review of Proposed Subdivision Plat and attached Soils Information for Individual Onsite Sewage Systems for TM 78 Parcel A-1 Dear Ms.Purtsezova, On April 5,2012,the County of Albemarle requested the Virginia Department of Health(via the Albemarle County Health Department)review a revision to the proposed subdivision plat identified above.This letter is to inform you that the above referenced subdivision plat is approved for individual onsite sewage systems in accordance with the provisions of the Code of Virginia,and the Sewage Handling and Disposal Regulations(12 VAC 5-610-10 et seq.,the"Regulations"),(and local ordinances if the locality has authorized the local health department to accept private evaluations for compliance with local ordinances).. This request for subdivision review was submitted pursuant to the provisions of§32.1-163.5 of the Code of Virginia which requires the Health Department to accept private soil evaluations and designs from an Authorized Onsite Soil Evaluator(AOSE)or a Professional Engineer working in consultation with an AOSE for residential development. This subdivision was certified as being in compliance with the Board of Health's regulations by: Steve Gooch,AOSE#1940 000278. This subdivision approval is issued in reliance upon that certification. Pursuant to §360 of the Regulations this approval is not an assurance that Sewage Disposal System Construction Permits will be issued for any lot in the subdivision identified above unless that lot is specifically identified on the above referenced plat as having an approved site for an onsite sewage disposal system,and unless all conditions and circumstances are present at the time of application for a permit as are present at the time of this approval. This subdivision may contain lots that to do not have approved sites for onsite sewage systems. This subdivision approval is issued in reliance upon the certification that approved lots are suitable for "traditional systems,"however actual system designs may be different at the time construction permits are issued. A revised drainfield exhibit was submitted to the Health Department on April 10th specifying the 5 foot setback from the property lines. All parts of the septic system must retain this required 5 foot property line setback on all lots. This subdivision approval does pertain to the requirements of local ordinances. I have not received anything from the county so I unfortunately cannot sign off on it. I have looked at the plat you sent me and the drain fields do not appear to have moved and are within the property lines, however this is not really an approval because I have not seen a version of what the county is reviewing. I would be negligent to approve an electrical copy that could be significantly different from what the county has in their hands. The last copy I have had on my desk is from the original subdivision in 2010. I also checked with our office staff and they have no record of receiving any alteration reviews to an existing subdivision. Once I have this request and plat in hand I do not imagine it taking a long time to review given it matches the electronic copy. Again I understand your frustration with the hold up, however I have not received any request from the county to review anything so therefore I cannot formally sign off on any alterations to a subdivision until that time. It had been my understanding that the paper copy(s) are submitted to Kelly&Josh when we've made previous submissions of the plat (isn't that why we turn in 10 copies?) Point being, Kelly&Josh, we made some changes to the lot lines for the final plat, and Joanne needs you all to sign off that this did not affect the previously approved drainfields.
