HomeMy WebLinkAboutZMA201600022 Action Letter 2019-05-15ORDINANCE NO. 19-A(4) ZMA 2016-00022 AN ORDINANCE TO AMEND THE ZONING MAP FOR TAX MAP PARCEL 09000-00-00-035L0 WHEREAS, the application to rezone 0.9 acres from RI Residential to PRD, Planned Residential, for Tax Map Parcel 09000-00-00-035LO is identified as ZMA 2016-00022 Moss (2511 Avinity Drive) ("ZMA 2016-00022"); and WHEREAS, on September 26, 2017, after a duly noticed public hearing, the Planning Commission deferred action on ZMA 2016-00022 to allow the applicant time to address issues of concern; and WHEREAS, on March 19, 2019, after a duly noticed public hearing, the Planning Commission recommended approval of ZMA 2016-00022, with provisos; and WHEREAS, on May 15, 2019, the Albemarle County Board of Supervisors held a duly noticed public hearing on ZMA 2016-00022. BE IT ORDAINED by the Board of Supervisors of the County of Albemarle, Virginia, that upon consideration of the transmittal summary and staff report prepared for ZMA 2016-00022 and their attachments, including the revised application plan, the information presented at the public hearing, any written comments received, the material and relevant factors in Virginia Code § 15.2-2284 and County Code § 18-19, and for the purposes of public necessity, convenience, general welfare and good zoning practices, the Board hereby approves ZMA 2016- 00022 with the Application Plan entitled "ZMA Application Plan for 2511 Avinity Drive", prepared by Shimp Engineering, PC, dated December 12, 2016, last revised on January 8, 2019. *rm I, Claudette K. Clerk, Board of County Supervoki Aye Nay Mr. Dill Y Mr. Gallaway Y Ms. Mallek Y Ms. McKeel Y Ms. Palmer Y Mr. Randolph Y RESOLUTION TO APPROVE SPECIAL EXCEPTION TO MODIFY THE MINIMUM AREA REQUIRED FOR A PLANNED RESIDENTIAL DEVELOPMENT DISTRICT ON TAX MAP PARCEL 09000-00-00-035LO IN CONJUNCTION WITH ZMA201600022 MOSS (2411 AVINITY DRIVE) WHEREAS, the Owner of Tax Map Parcel 09000-00-00-035L0 filed a request for a special exception to modify the minimum area required to establish a district for a Planned Unit Development from three acres to 0.9 acres in conjunction with ZMA201600022 Moss (2511 Avinity Drive). NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the transmittal summary and staff reports prepared in conjunction with the special exception request and the attachments thereto, including staffs supporting analysis, and all of the factors relevant to the special exception in Albemarle County Code §§ 18-19, 18-33.43, and 18-33.49, the Albemarle County Board of Supervisors hereby approves the special exception to modify the minimum area required to establish a Planned Unit Development District as requested, subject to the condition attached hereto. The area of the Planned Residential Development shall be no less than 0.9 acres, and shall include the elements depicted on the Application Plan exhibits entitled "Open Space Exhibit' and "Courtyard Exhibit" prepared by Shimp Engineering, PC, and dated August 14, 2018.
