Or 3 new easements? • Which of these easements are required for County approval of the (Final) Site Plan?Which of these proposed easements are not required for County approval of the (Final) Site Plan, and are simply a private agreement between two private parties/entities? o Note: I'm not entirely clear on whether Proffer Statement#4 from ZMA-2001-00015 should be interpreted to mean that an access easement (such as the one shown on the draft special lot plat) is required in conjunction with any Final Site Plan or Final Plat. I've attached that action letter(containing the proffer statement) for everyone's reference. • For proposed new easements that you anticipate being a requirement in conjunction with the (Final) Site Plan, you may include those on this special lot plat— provided that you do the following: o Submit fee payment for an "Easement Plat" (per S.O. 14-203.D), less the amount of fees paid previously for this special lot plat submission (which was presumably$95 per S.O. 14-203.C.3); and o Add all necessary property ownership info and owner's "statement of consent" signature area for TMP 78-20M1; and o Produce and submit for County review/approval any deeds which may be necessary in conjunction with any of the easements that will be required for County approval of the (Final) Site Plan. o After approval and recordation, reference the DB/PG for these recorded easements on the Final Site Plan (and WPO Plan, as may be necessary). • For proposed new easements which are simply a private agreement between two private parties/entities, and which are anticipated to be required in conjunction with the (Final) Site Plan: o Such proposed new easements can remain on this special lot plat, without any additional fee payment, provided that you do the following: • Add a note or label to include the word "private" in the description; and • Add a note that states "Albemarle County does not have authority to require or approve these proposed new private easements, and approval of the Special Lot shown on this plat does not signify Albemarle County approval of or authority over these private easements;" and • Add all necessary property ownership info and owner's "statement of consent" signature area for TMP 78-20M1. You may also choose to do only some of the options listed above (for example, showing off-site easements that are completely private in nature), and wait to submit a separate easement plat in the future in conjunction with the final site plan. Staff recommends establishing easements (with corresponding deeds and other agreements, as may be applicable) in conjunction with the Final Site Plan and Water Protection Ordinance Plan review/approval processes. This will be easier for us (less time/effort spent dealing with the fees issues), and may be easier for you (to avoid a potential situation where you revise one or more previously-established easements, due to modifications or revisions to the Final Site Plan). 4 I hope this is helpful. And thanks for revising/clarifying the open space intent, and also for adding the steep slope zoning overlay districts. I'm going to have to look into the proposed new access and drainage easements— I don't know if those can be established on this "special lot plat,"those may need to be established on a separate "easement plat" (and if so, perhaps that can be included in the easement plat that will be required for the overall development of TMP#78-20M3). Establishing those easements might also require corresponding deeds, and if so that would involve review and approval by the County Attorney's Office. However, I do recognize that the proposed new easements are "off-site" (on TMP 78-20M1), so perhaps we can work with this plat as-is. I will need a little bit of time to look into those questions about the proposed new easements, and what steps are necessary in order to plat those.
