MAINTENANCE AGREEMENT
Attached hereto is a plat of Robert L. Lum, Land Planning
and Surveying, dated March 5, 1990 entitled "The J. D. Catlett
Property" showing Lots 1 and 2 formerly being a portion of Parcel
51 of Tax Map 131 on which is shown a 30 foot ingress and egress
easement to serve Lot 2 which passes over Lot 1 . The aforesaid
Lots 1 and 2 are presently owned by J. D. Catlett and Nancy T.
Catlett , husband and wife , and were acquired by deed found
recorded in the Circuit Court Clerk' s Office of Albemarle County,
Virginia in Deed Book 1052 at page 464 et seq.
The cost of the original road construction and thereafter
regular maintenance , upkeep or replacement of the aforesaid
access easement shall be paid as follows : one half by Lot 1 and
one half by Lot 2 . The original road bed for the access
easement shall be built according to the standards and
requirements of the County of Albemarle, Virginia.
Normal and usual maintenance and repair, snow removal, etc. ,
shall be done at any time that the owner or owners of the two
lots served by the easement so request. Major improvements to
the private road, such as upgrading the surface of the road,
shall be done at any time that the owners of the two lots served
by the easement so request.
By their signatures hereto, the respective owners of the
various lots and parcels served by the easement impose this
agreement as a restriction on their parcels so served and bind
themselves, their heirs and assigns, to this agreement. If any

owner by their negligence causes damage to the 30 feet easement,
the expense for those repairs shall be borne exclusively by the
negligent owner . During construction on any of the aforesaid
lots or parcels , the owner of the lot or parcel upon which
construction is occurring shall be individually responsible for
the cost of repairs made necessary by equipment making use of the
road during construction.
If any owner does not pay the appropriate costs as called
for herein within 30 days after a bill for such charges is
submitted, the other owner may claim a lien by filing notice of
such lien in the Clerk' s Office of the Circuit Court of Albemarle
County. The amount due shall bear interest at the maximum rate
provided by law from the date of filing, along with reasonable
costs and attorney' s fees . Said lien shall be prior to any
mortgage or deed of trust recorded subsequent to the date of
filing. Enforcement of said lien shall be by the same procedures
required for a foreclosure sale under a mortgage.
The cost of construction, maintenance, upkeep or replacement
of the private road or 30 foot easement will not be borne by the
County of Albemarle, the Commonwealth of Virginia, or any other
public agency, unless said private road or 30 foot easement be
accepted into the State road system.
