D. Catlett Post Office Box 385 Scottsville, VA 24590 RE: Proposed Subdivision Tax Map 131, Parcel 51 Dear Mr. Catlett: Ms. Jan Sprinkle, Planner, has been reviewing your proposed subdivision. The plat dated December 26, 1989 is not approvable since Lot 1 does not have adequate lot width. That issue aside, Ms. Sprinkle recommended an alternate scheme of development (front-to-back division) which I believe would be superior, but I understand to be unacceptable to you. Ms. Sprinkle' s intent is to provide more suitable lots consistent with ordinance provisions and to avoid possible future problems to the lot owners. I have reviewed the plat and concur with Ms. Sprinkle' s assessment that the proposed division is contrary to Section 18-29 Shape, of the subdivision ordinance: The lot arrangement, design, and shape shall be such that lots will provide satisfactory and desirable sites for building. Lots shall not contain peculiarly shaped elongations which are designed solely to provide necessary square footage of area or frontage on a public road and which would be unusable for normal purposes. Setbacks for building shall be as specified in the Zoning Ordinance. 1. Even if redrawn to provide lot width, Lot 1 would have an extremely limited area for building location if Lot 2 is to have 250 feet of frontage on Route 773 . Therefore, Lot 1 may not have a "satisfactory and desirable building site. " J. D. Catlett Page 2 January 29 , 1990 2. Lot 2 would narrow-down to fifty feet or less and leave an area adjacent to State Route 773 in excess of one acre unavailable for building purposes. The purpose of this configuration appears to be to obtain 250 feet of frontage for both lots. 3 . Future division of Lot 2 would require a front-to-back division which would further limit area available for building location on Lot 1 due to additional setback requirements. 4. Please also be advised that should there prove to be problems in meeting setbacks or other requirements of the Zoning Ordinance that a self-imposed hardship does not represent basis for a variance of County regulation. This office remains prepared to assist you in the development of your property consistent with the provisions of the various ordinances and good planning. However, this office will be unable to administratively approve the subdivision as has been proposed. You may appeal this decision to the Albemarle County Planning Commission upon written request.
