Poole 5607 Lambshire Drive Raleigh, N.C. 27612 July 17, 2002 VIA HAND DELIVERY County of Albemarle Department of Planning&Community Development 401 McIntire Road,Room 218 Charlottesville, Virginia 22902-4596 To Whom It May Concern: This letter is written in support of a formal request for a waiver from certain requirements of the Code of the County of Albemarle (the "Code") pursuant to Section 14-514 Standards for private roads only and is made pursuant to Section 14-237 Waiver, variation, or substitution of requirement of the Code. The request is made specifically to allow for relief from the application of the 3-5 lot standard for private roads by applying the 2 lot standard for private roads under the Code. Background I am making this request as Executor of the estate of my late father, Gilmore Emerson Waldman. My father passed away on February 26, 2002 and in his Last Will and Testament(the "Will"), he disposed of certain real property located in the County of Albemarle (the"County") commonly known as Beckoning Ridge Farm(the"Property"). A copy of such relevant language in the Will is attached hereto as Exhibit A. The disposition of the Property was made to my sister, Jeanne W. Miles and me. As further evidence of the disposition of the Property, I attach a copy of the plat from the Will as Exhibit B hereto. As the Will and plat clearly indicate, the Property, consisting of approximately 56 acres, is to be divided into two (2)parcels roughly equal in acreage. As the Executor of the estate, it is my responsibility to ensure that my father's intentions, as expressed in his Will, are satisfied. In administering my duties as Executor,however, I have learned that my father's desire to dispose of the Property through a"family division"presents a technical deficiency. Because the intended division of the Property was approved by Department of Planning&Community Development(the "Department")but not put to record before his death, I am told that the estate is required to proceed with a subdivision of the Property pursuant to Section 14-206 of the Code and furthermore is required to undertake significant modifications to the private road currently servicing the Property pursuant to Section 14-514 in order to satisfy the Code's prescribed standard for 3-5 lot divisions. Support for Waiver Request In connection with the estate's request for a waiver from the Section 14-514 standards for 3-5 lots, I feel it is important to inform the Department of the following facts that support the application of the 2 lot private road standard to the division of the Property. • In August, 1997, as part of my father's estate planning,he began the process of dividing the Property utilizing the family division process. To that end,he had a plat drafted(see Exhibit B attached hereto) dividing the property into six (6) separate lots (lots A-F). This plat was approved by the Department on August 12, 1997. Unfortunately,however,my father failed to record this plat which,had it been recorded would have been approved with the current road servicing the land and the appropriate access easements. • The division of the Property under the terms of the Will only divides one lot into two (see plat attached hereto as Exhibit C); a division much less taxing to the Property than the division into six (6) lots. • If my father was alive today and attempted to divide the Property as he did in his Will,the family division pursuant to Section 14-208 would pose no problems under the Code, and, with the current road, would be approved by Department staff. • The private road currently used by the Property provides reasonable access by motor vehicles as required by Section 14-514 of the Code. • In the matter of Ms. Rebecca Rush, in March 2001,the Department granted approval of a similar request for a waiver and allowed the private road standard for 2 lots to be applied(see letter attached hereto as Exhibit D). Ms. Rush's facts were not dissimilar from the facts presented in the estate's request. Ms. Rush's mother died leaving a parcel of land to be divided between her two daughters. She failed, however,to utilize the family division process to effect the transfer and division. Ms. Rush therefore requested a waiver from the Department of the 3-5 lot standard,thereby allowing the 2 lot standard to apply as it would have in a family division of the property. Conclusion As Executor of my father's estate, I am trying to fulfill my obligation to the estate and facilitate the division of the Property according to the terms of his Will. It is not the estate's intention to request this waiver for any reason other than to complete the transfer of property among family members. I recognize that the division of the land may be achieved by other means,but it does not seem fair or reasonable to require the estate to proceed with such a process when granting the waiver achieves the intent of my father and does not run afoul of the spirit of the Code. Furthermore, granting the request serves the public interest, is equitable and would not be detrimental to the public health, safety or welfare or cause any problems to adjacent land. I appreciate the opportunity to present this support for a waiver from certain private road standards under the Code and hope that the Department approves this request and allows the Property to be dividing as my father had intended.
