RE: SUB 00-0006 Revised Lots 9 & 10 Grayrock Orchard
Dear Anita:
Our Zoning department has reviewed this requested change to the lot arrangement and must disapprove
the plat because it does not conform to proffers related to Grayrock Orchard ZMA. Proffer#2.5 Inter-
Parcel Access of ZMA 97-12 specifies a fifty foot right of way in this location. Therefore, this redivision
can not be approved.
Engineering comments are as follows:
The revision must show the sidewalk easements. [14-303e]. Engineering would like it clarified as to who
is responsible for maintaining the sidewalks along the interparcel connector roadway. If maintaining a
sidewalk is the responsibility of the homeowner or a homeowners association, this should be stated in any
covenants for the property. VDOT policy states that the limits of the right-of-way shall not be less than
one (1) foot beyond the back of the sidewalk. [24 VAC 30-90-150]
Because of the inability of our Zoning Department to approve the plat, the Planning Depai tinent has not
continued in a review of the plat and offers no comments at this time. I did speak to Tom Muncaster,
however, and he is talking to the Fried Company about amending the proffer.
We will place this letter in the file and, should the proffers to Grayrock Orchard ZMA 97-12 be modified,
you may request a reinstatement of the plat with a fee for$50.00.
