LINCOLN LAND SURVEYOR, 671 Berkmar Circle Charlottesville, Virginia 22901 Office (804) 974-1417 Fax (804) 974-1776 February 21, 2002 Ms. Yadira Amarante County of Albemarle 401 McIntire Road Charlottesville, Virginia 22902 Re: Waiver Request Access From Lot Onto Public Street (Section 14-505.B) Lots 8, 9, 10 Garland-Mason Subdivision Dear Yadira: I respectfully request a waiver/variance for access from Lots 8, 9 and 10 onto a public street, being Old Lynchburg Road, State Route 631 per Section 14-505.B of the Albemarle County Code. I seek the waiver/variance as authorized under Section 14- 237 (Waiver, variation, or substitution of requirement) by virtue of Section 14-237C and Section 14-505 B. The parcel in question fronts over 870 feet on State Route 631 (Old Lynchburg Road) and has over 400 feet of frontage on State Route 712 (Plank Road). I have contacted Mr. Charles Baber of VDOT and he has looked at the proposed entrances and has determined that there is satisfactory sight distance at the selected entrances along Old Lynchburg Road. Mr. Baber noted that the frontage along Plank Road was not suitable for an entrance to Lot 10 because the road is in a curve there and minimum sight distance could not be met at any location along Plank Road. Additionally there is a steep embankment between the road and the building site on Lot 10 (an area of critical slopes in excess of 25%). Mr. Baber looked favorably upon the three proposed entrances noting that the sight distance along Old Lynchburg Road was in excess of the minimum required and that a minimum of excavation would be necessary to install each entrance. Garland-Mason Subdivision February 21, 2002 Page 2 As can be seen on the preliminary plat there is an old cemetery located on Lot 9. The proposed lot lines and building sites for these three lots have been carefully situated so as to preserve this old cemetery. The topography of the property lies with a gentle ridge running parallel to Old Lynchburg Road and the three lots have been situated to utilize this terrain. Sound engineering practice suggests that accessing the three lots with individual driveways will help preserve the cemetery, preserve vegetation and minimize earth disturbing activities. The property is wooded and the three proposed driveways will require a minimum amount of grading and vegetative cover removal. The justification for the waiver is that of significantly less environmental impact and preservation of the old cemetery. Less vegetation will be removed and less earth disturbing activity will be required. Requiring the application of the standard would not forward the purposes of the county code and granting the waiver would not be detrimental to the environment (as shown above), public health, safety or welfare, to the orderly development of the area, to sound engineering practices, and would be consistent with the current standards of the surrounding neighborhood. (14' x 1')+(2(4') x 1') = 22.00 sq. ft./If Private Driveways 1 . Driveways 3(10)(0.5) = 15.00 sq. ft. Percentage of Savings 22.00 - 15.00 = 32% > 30% 22.00 Using these figures for simple driveways shows that more than the required 30% savings in earth disturbing and vegetation disturbance. Requiring the application of the standard would not forward the purposes of the county code and granting the waiver would not be detrimental to the environment (as shown above), public health, safety or welfare, to the orderly development of the area, to sound engineering practices, and would be consistent with the current standards of the surrounding neighborhood.
