Box 5207 Charlottesville, VA 22905 RE: Letter Dated August 25, 1998 Dear Don: Thank you for your letter of August 25, 1998. Indeed, we have been considering the issue of access to Springridge to be a part of the Springridge rezoning project. It has been and continues to be our understanding that the only r.o.w. of sufficient width to serve the Brown property is the one which is being used currently for the bikepath at Forest Lakes South. In order to develop the Springridge parcel, use of the bikepath for access and a stream crossing seem to be essential. Tomorrow I am meeting with Greg Kamptner, the Assistant County Attorney to make sure that he agrees that you all have the legal standing to go forward with proposals to provide access through the properties you have identified. He has reviewed the documents you previously provided and wants to go over them one last time before getting back with you. With regards to your comments in your letter, we will develop a full staff report on the minor amendment to Forest Lakes South as well as the special use permit for the stream crossing . The requests can either continue with the Springridge ZMA or go separately, although it is our opinion that they should be processed together for ease of understanding by the Planning Commission and the public. Our analysis of the request has not raised any significant issues, except for the proposed addition of a daycare or church at the end of Ashwood Boulevard. In our review of this request, we have several questions for which answers from you will be needed. First, where exactly is the area for the daycare or church? Most of the area shown on the plan is in the floodplain and we cannot find the area you intended for development. Second, what might be the maximum size or area of the daycare or church. VDOT indicated that they approved the design for Ashwood Boulevard with no uses other than single family residential. The addition of this use may affect the design requirements for Ashwood, according to a letter from VDOT dated May 18, 1998. I believe you may already have a copy of this letter. Issues that will be raised in our staff report include the relationship of this use to the neighborhood, relationship of the use to the proposed Meadowcreek Parkway, and the timing of construction of the Meadowcreek Parkway. Traffic generation and its impacts to the neighborhood will also be considered. These are standard special use permit issues. Since they have no relation to the proposed Springridge rezoning,they will require additional attention at the public hearing for this item. I have asked Zoning and Engineering for detailed comments on this aspect of the rezoning which I hope to receive this week. I apologize that we have taken so long to get you comments on this aspect of your rezoning proposal. Please let me know if I can provide any additional information to you. As you are aware the proposed changes to the Forest Lakes South Application Plan include the designation of a church/daycare site at the end of Ashwood Boulevard and delineation of an access route to TMP 46-35 through a peripheral portion of the development. While this access is integral to the development of Springridge, it should not be viewed as contingent to approval of ZMA 98-13. We remain of the opinion that regardless of the final outcome of ZMA 98-13, the access makes sense. We feel that to act in any other manner will continue to land lock acreage designated for development as part of the Hollymead Community in the Comprehensive Plan. As you should be aware, the matter of this rezoning has been caught up with ZMA 98-13 since submitted on 20 April 1998. I assume that it is because of this confusion, that I have not received written comments, with the exception of the VDOT comments dated 18 May 1998. While the proposed uses were not included in the original master plan, we consider them consistent with those in other residential developments and as such, logical and reasonable requests. It remains our desire to have this rezoning request considered on its own merits. Should any of your review comments change our mindset, we will advise you in writing.
