The bond may be released. This is allowed by the subdivision ordinance language below:
14-229 Period of validity of approved final plat.
A final plat for a subdivision which is not a phased subdivision eligible to be subject to section 14-
230 shall be valid for the following periods:
A.A final plat shall be valid for a period of one(1)year from the date the agent affixes his
signature to the plat, or for any other period specified in a surety agreement entered into by and between the
subdivider and the county, whichever is later, if: (i)the subdivider has commenced construction of facilities
to be dedicated for public use pursuant to an approved plan or permit with approved surety;or(ii)the
subdivider has furnished surety in a form authorized by section 14-435(A) in the amount of the estimated
cost of construction of the facilities.
The plat was signed 6/7/04 therefore it expires on either 6/7/05 or for such time as agreed to by the surety. owners
wants to discontinue the surety the plat will automatically become void and not recordable. If it is recorded it will be in
violation of the subdivision ordinance.

Due to current uncertainties in the housing markets, the current financial credit/financial
uncertainties, and anticipated recession possibilities, this is not a good time to develop Indian
Springs Subdivision -Hahn Lane There has been no work done to date, and I do not plan to
make any bonded improvements in the near future.

Although the plat was signed on 6/7/04, the final plat was never recorded.
I do not plan on recording the plat,:,and request that the subdivision and
water protection performance bonds that were posted for this project be
released.
