Family Division Dear Mr.Gloeckner , The Department of Building Code and Zoning Services has made a determination that the proposed Beryl L. Knasel Family Division cannot be approved. There are no development rights available for the area proposed to be included in Lots 2 through 5. In all divisions relying on development rights, a core area (or"kernel") of two acres from the original parcel of record of December 10th, 1980 along with an accompanying development right must be included within the area of any new lot created. A copy of a memo dated July 16th, 1998 from our Zoning Department is attached. Section 10.3.1, Conventional Development states, "Regulations in section 10.5 governing development by right shall apply to the division of a parcel into five (5) or fewer lots of less than twenty-one (21) acres in area and to the location of five (5) or fewer dwelling units on any parcel in existence at the time of adoption of this ordinance (reference sections 1.3 and 6.5.3). . . " The part of parcel 20A•proposed to be divided into lots 2 through 5 was part of parcel 43B on December 10, 1980 (the time of adoption of this ordinance.)
