RE: Tax Map 94, Parcel 22 Subdivision for Bob Martin
Dear Mr. Whelan,
This letter is a follow up to our previous phone conversation. The proposed division of Tax Map 94,
Parcel 22 cannot be approved by the County. A copy of the plat is attached for your reference. Please
note that while the plat does not show the County line the property lies in both Albemarle and Fluvanna
Counties. Our review is only on that area which lies within Albemarle County. Please contact Fluvanna
County for review of that portion lying in Fluvanna. The proposed subdivision does not comply with the
following provisions of the Albemarle County Zoning Ordinance:
1. [10.4] That portion of Lot A lying in Albemarle County does not satisfy the minimum lot
requirements in Albemarle County. The minimum lot size is two acres. That portion of Lot A
lying in Fluvanna County does not satisfy the minimum lot requirements for Fluvanna County
based on my understanding of their ordinance.
The plat as submitted does not meet the following requirements of the subdivision ordinance:
1. [18-55b] Owners signature;
2. [18-55h] Tie down to existing street intersection;
3. [18-55p] Allocation of development rights in accord with the provisions of Section 10.3.1
of the Zoning Ordinance;
Health Department approval will be required in accord with the provisions of Section 18-23 of the
Subdivision Ordinance.
It is my understanding that the purpose of this subdivision is to allow for the construction and rental of a
dwelling. This may be accomplished without subdivision with the approval of a site plan in accord with
Section 32.2.1 a or a site plan waiver in accord with Section 32. 2.2. If you desire to pursue approval of a
site plan or site plan waiver please contact me.
