Subject: SP202100015 Midway -Martin's Store 115kV Transmission Line
Dear Scott:
We are in receipt of your letter regarding Central Virginia Electric Cooperative's
submittal for a special use permit application. Please find your review comments
below in black with responses in blue italics.
Engineering (Frank Pohl)
Show the limits of the 100-yr floodplain on all sheets, where applicable. New
poles are allowed "by -right" to be located within the floodplain overlay district
(18-30.3.11), however, a Floodplain Development Permit is required if any are
located within the district. If the Structure Mat Pads are located with the
floodplain, please provide pad dimensions and a detail/section of the pad,
including existing and proposed grade and pad elevations.
0 The following poles lie within the 100-year floodplain elevations and are
shown on the attached drawings. A Floodplain Development Permit is
anticipated.

No structure mat pads are located within the floodplain areas. Rubber
tracked vehicles will be utilized in order to protect sensitive areas.
Please provide the total land disturbance area, including areas to be cleared
and the disturbance related to installing the Structure Pads. Please provide a
detail of the Structure Mat Pads, including dimensions at leach location. A
VSMP permit is required prior to the start of land disturbing activities if the
cumulative land disturbance area exceeds 10,000 sf (Chapter 17, Albemarle
County Code).
o The total land disturbance area is 76.36 acres.
o Area to be cleared is 1.56 acres.
o Structure pad area is 0.05 acres. Structure pads are laid over the
native soil and vegetation and minor to no disturbance is anticipated
from the matting. The area will be reseeded and stabilized after
matting is removed per the regulations.

• Show the stream buffer on all sheets, where applicable (17-600).
o A 50-foot buffer has been shown off the Mechums River and its
tributaries per Albemarle County Water Protection Ordinance (WPO).
Please describe the "bridge matting" to be used on indicated stream crossings:
does the matting span the streams that being crossed, or does it rest on the
streambed and banks? (If the latter, staff may recommend a condition
requiring alternative structures to span the streams, to avoid impacts to the
streams.)
o A metal bridge will span 70' across the creek, will extend shoreline to
shoreline and will not be removed until the work is completed. S
o Indicate the potential impacts on streamside soil and vegetation; and
list measures the measures that will be used to restore the bridge
matting area after the matting is removed.
Permanent or temporary soil stabilization shall be applied to denuded
areas within seven days after final grade is reaches on any portion of
the site. Temporary soil stabilization shall be applied within seven days
to denuded areas that may not be at final grade but will remain
dormant for longer than 14 days. Permanent stabilization shall be
applied to areas that are to be left dormant for more than one year.
• On Sheet 1, at pole location 2, there is a "clearing area" that appears to extend
outside the existing right-of-way. Is new right-of-way required for this area, or
is this only temporary clearing being done for construction -access purposes?
o The clearing area on Sheet 1 at Pole 2 is now shown within the right-of-
way. Any access -related activity outside of the existing right-of-way is
for construction access purposes only and does not require new right-of-
way.
To clarify the relationship between this use and the recently -proposed soar
facility for TMP 85-17B - on page 8 of the application narrative, response #3
says, "The Midway Solar Project will not interconnect to the CVEC 115kV
transmission line." If this is the case, what will the solar project connect to? Is
a new line planned, either along this existing corridor or otherwise?
o The Midway Solar Project is totally independent of the Midway - Martin's
Store 115kV Transmission Line Project. The Midway Solar Project will
not interconnect to the CVEC 115kV transmission line. The solar project
will connect to an existing distribution line within the existing easement.
The existing distribution runs parallel to the existing 115 kV
transmission line. The existing 115 kV transmission line will be
removed once the new 115 kV transmission line is constructed. The
existing distribution line will remain untouched where the Midway Solar
project will interconnect. There is not any new distribution line planned
or required.

Review Comments

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a resubmittal date as
published in the project review schedule. The full resubmittal schedule may be found at www.albemarle.org
in the "forms" section at the Community Development page. Be sure to include the resubmittal form on the
last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each
subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request an indefinite
deferral. Please provide a written request and state your justification for requesting the deferral. (Indefinite
deferral means that you intend to resubmit/request a public hearing be set with the Planning Commission
after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we do not advise
that you go directly to public hearing if staff has identified issues in need of resolution that can be addressed
with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public hearing, staff will
set your public hearing date for the Planning Commission in accordance with the Planning Commission's
published schedule and as mutually agreed by you and the County. The staff report and recommendation will
be based on the latest information provided by you with your initial submittal or resubmittal. Please
remember that all resubmittals must be made on or before a resubmittal date.
By no later than twenty-one (21) days before the Planning Commission's public hearing, a newspaper
advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule.) Your
comment letter will contain the actual fees you need to pay. Payment for an additional newspaper
advertisement is also required twenty-two (22) days prior to the Board of Supervisors public hearing.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning
Commission's public hearing will be allowed during the life of the application. The only exception to this rule
will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more
issues identified by staff that have not previously been brought to the applicant's attention. As always, an
applicant may request deferral at the Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that time, you will
be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of
your application to a specific Planning Commission date as mutually agreed to with staff, or c) request
indefinite deferral and state your justification for requesting the deferral. If none of these choices is made
within 10 days, staff will schedule your application for a public hearing based on the information provided with
your original submittal or the latest submittal staff received on a resubmittal date.
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make checks
payable to the County of Albemarle. Do not send checks directly to the Review Coordinator. Fees may also be
paid by credit card using the secure online payment system, accessed at

Most applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
