RE: Yancey Lumber VA 2002-018 — proposed rotary log crane
This item was heard and deferred from the December 3rd Board meeting to allow
additional information to be prepared by the applicant. The Board asked the applicant
to consider changes that would result in the log crane being lower in height and further
from Route 250. As a result, the proposal has been amended to a) lower the crane by
12 feet and to b) not utilize the crane for logs stacked along Route 250.
Staff also discussed with the applicant the idea of removing or relocating existing
structures so as to move the proposed log crane more internally into the site and away
from roads. We have been told that the applicant would consider this and have not
received information as to this analysis. As the Board may recall, staff asked in the
report whether a smaller log crane could be better accommodated on this particular site.
We have not received further information on this question.
There are no additional drawings or written information from the applicant to provide to
the Board at this point. While staff supports the applicant's efforts to lower the crane
and move the activity further from Route 250, we are still unable to find evidence of
undue hardship and the other Code criteria related to the approval of a variance.
Therefore, staff continues to recommend denial.
In the event the Board should find cause for approval, we recommend the previous
conditions of approval with two additions to incorporate the proposed changes to the
application (additions are shown in italics):
1. No new site lighting associated with the use of the crane shall be installed. The
crane equipment itself shall not be lighted,prior to 7 a.m. or after 5 p.m.

2. The rotary log crane shall not be used to stack logs along the Route 250
frontage. Logs shall not be stacked higher than 30 feet along Route 825.
3. Logs shall not be stacked any closer than 30 feet to the property line along Route
250.
4. Planning Department approval of a landscape plan which shows a ten-foot strip
parallel to Route 250 and along the northwest corner. Provide a continuous
mixed informal planting consisting of 2 to 3 different species of screening trees
with interspersed shade trees along the full distance of the Route 250 frontage,
allowing for necessary ingress/egress. Integrate proposed landscaping with
existing trees, showing the existing trees on the plan. Screening trees shall be a
minimum of 6-8 feet in height at the time of planting.
5. Provide a plan that clearly shows the access points into the site from Route 250,
for proper coordination with the landscape plan.
6. County Engineering Department approval of measures, if any are necessary, to
prevent logs from rolling off the stack and into Route 250 or Route 825.
7. The height of the rotary log crane shall not exceed 88 feet.

YANCEY LUMBER COMPANY - ROTARY LOG CRANE
Two zoning regulations apply to the setback and separation between the log crane and
various property lines or dwelling on other property. These regulations are 1) Industrial
Zoning district regulations for structure setbacks and 2) Supplementary regulations
relating to sawmills.
We also need to discuss the height regulations in the industrial district.
I. 5.1.15 SAWMILL, TEMPORARY OR PERMANENT
Each temporary or permanent sawmill shall be subject to the following: (Added

a. No structure and no storage of lumber, logs, chips or timber shall be located
closer than one hundred (100) feet to any lot line. Trees and vegetation within
the one hundred (100) foot setback shall be maintained as a buffer to
adjoining properties and uses, provided that during the last three months of
operation such trees may be removed;
b. No saw, planer, chipper, conveyor, chute or other like machinery shall
be located closer than six hundred (600) feet to any dwelling on other
property in the area;
c. No sawing, planing, chipping or operation of other processing machinery shall
occur between 7.00 p.m. and 7:00 a.m. No loading/unloading of wood/wood
products shall occur between 12:00 midnight and 7:00 a.m.;
d. All timbering and milling operations, including reforestation/restoration and
disposal of snags, sawdust and other debris, shall be conducted in
accordance with Title 10.1 of the Virginia Code and the regulations of the
Virginia Department of Forestry; (Amended 10-3-01)
e. All such operations shall be subject to the noise limitation requirements of
section 4.18. (Amended 10-3-01)
There is a house as close as 213 feet to the proposed crane. There are other houses
within the 600 foot distance. This will require a waiver from the Planning Commission.

II. 26.6 HEIGHT REGULATIONS
Except as otherwise provided in section 4.10, structures may be erected to a
height not to exceed sixty-five (65) feet; provided that any structure exceeding
thirty-five (35) feet in height shall be set back from any street right-of-way or
single-family residential or agricultural district; in addition to minimum yard
requirements, a distance of not less than two (2) feet for each one (1) foot of
height in excess of thirty-five (35) feet. (Amended 9-9-92)
III. 26.10 MINIMUM YARD REQUIREMENTS
26.10.1 Adjacent to public streets: No portion of any structure, excluding signs, shall
be erected closer than fifty (50) feet to any public street right-of-way. No off-
street parking or loading space shall be located closer than ten (10) feet to any
public street right-of-way. (Amended 7-10-85; 7-8-92)
26.10.2 Adjacent to residential districts: No portion of any structure, excluding signs,
shall be located closer than fifty (50) feet to any rural areas or residential district
and no off-street parking space shall be closer than thirty (30) feet to any rural
areas or residential district. For the heavy industry (HI) district, no portion of any
structure, excluding signs, shall be located closer than one hundred (100) feet
to any rural areas or residential district and no off-street parking shall be
closer than thirty (30) feet to any rural areas or residential district. (Amended 7-
10-85; 7-8-92)
The proposed crane will be on the property line with property zoned Rural Areas.
• HEIGHT REGULATION IS MAXIMUM OF 65 FEET; Crane will be 100 feet high.
VARIANCE OF 35 FEET IN HEIGHT
• INCREASED SETBACK BASED ON HEIGHT = 100-35 = 65 FEET X 2 FEET OF
ADDITIONAL SETBACK = 130 FEET OF INCREASED SETBACK
• ELK REGULATIONS ARE:
FEET FROM RT 250 (underlying); Have 63 tt Okay
• B) 50 + 130 = 180 FEET FROM ROUTE 250 (based on height); Have 63 ft, need
117 ft variance.
• C) 50 FEET FROM ROUTE 825 (YANCEY MILL LANE) (underlying); Have 30 ft,
need 20 ft variance.
• D) 50 + 130 = 180 FEET FROM RT. 825 (based on height); Have 30 ft, need 150
ft.
• E) 100 FEET FROM RA DISTRICT (underlying); Have 0 ft, need 100 ft variance.
• F) FROM RA DISTRICT 100 FEET + 130 FEET = 230 FEET (based on height).
Have 0 ft, need 230 ft variance.
