Subject: Yancey Lumber Variance (VA 2002-018)
Yancey Lumber company began use of the property in 1949, prior to the adoption of zoning in
Albemarle. It was my understanding that existing structures and equipment were either legally
nonconforming or were exempt from the requirement of a building permit. It is my recollection that
then Building Official, Jay Schlothauer, said that the rotary crane and other structures onsite were
considered equipment and were not subject to a building permit.
The need for this 2002 variance was based on Yancey Lumber's proposal for a rotary log crane.
Our review of the variance was focused solely on the proposed use. At the time of the variance
review, there were no observable concerns relating to public health or safety and there were no active
zoning complaints for this property. Therefore, based on consistent administrative practice, further
investigation of the use or structures on the property was not prompted by the Zoning Department.
On February 4, 2003, the Board of Zoning Appeals approved 3 variances related to this approval that
were subject to 9 conditions of approval.
