Chadwick TAX MAP/PARCEL: 61 K/ Section 5-C/ Parcel 13 ZONING: R-4, Residential/ Airport Protection Overlay LOCATION: 101 Inglewood Court at the intersection with the eastern portion of Inglewood Drive TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance from Section 15.3 which requires a 25 foot front setback. This variance is necessary to si-ows the construction of an 12-foot by 44-foot addition for an accessory apartment, 10 feet from the right-of-way of Inglewood Drive, a variance of 15 feet. r)f. ° sah RELEVANT HISTORY: On December 20, 1983 the Planning Commission approved the preliminary plat for the Georgetown Lane Subdivision. That approval precluded the through connection of Inglewood Drive. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: This is a corner fitin the Oak Terrace Subdivision. This propertyis im roved with_ailmigig and a small fl s ed. Staff finds that the owners now enjoy reasona use of their property based on these improvements. In order to meet the criteria for hardship, the Board must find that the enforcement of the 25-foot front setback from the stem road would effectively prohibit or unreasonably restrict the use of the property or that the granting of a variance will alleviate a clearly demonstrable hardship approaching confiscation as distinguished from a convenience sought by the applicant. Staff has identified an alter location on the rear of the dwelling that could accommodate the addition wi out the need for this variance. When the lots in this neighborhood were originally platted, Inglewood Drive was intended to be one continuous road. However, the platting of the Georgetown Lane Subdivision in 1983 eliminated that possibility. Gerald Utz, Contract Administrator of VDOT, has confirmed, in a letter dated September 4, 2002, that VDOT has no plans for any improvement to Inglewood Drive or any of the adjoining streets in the area. Therefore, the stem of Inglewood Drive is now a 50 foot public right of way containing a shared driveway serving only two parcels, Lot 4 in Section 5D and Lot A in Section 10. The subdivision ordinance would permit a shared driveway to be constructed within a 30-foot easement. In the event that the right of way was reduced by 10 feet on each side, this request would still require a variance of 5 feet. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: I:IDEPT1Bwlding&Zoning12002 staff reportstVA-2002-024 Chadwick.doc Variance Report, VA 2002-024 2 October 1, 2002 Hardship The applicant comments that the variance is necessary: • The intended use requiring this variance is to provide an accessory apartment designed to be handicapped accessible. Of necessity, the parking and front entry will require that the addition will lie roughly parallel to the adjacent road stem. Egress can be provided from the main house, toward the front, but a bedroom negates extending the addition to the rear without need for the variance. Staff accepts the reasoning of the applicant that the location of the addition as requested would be more desirable than placing it to the rear of the house based on the floor plan of the dwelling and the landscaping improvements in the rear yard. However, it is staff opinion that the addition could be located in the rear yard without the need for this variance. Based on the current reasonable use of the property and the alternative location available for the proposed addition, it is staff's opinion that the granting of this variance would be a convenience to the applicant and that it does not meet the standard for a finding of hardship. 1. The applicants not provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant notes: • The use of this property is limited by the setback from a road stem created to provide a temporary turn-around easement granted VDOT. The slope of the land, and the unlikelihood of extending Inglewood Drive where a private drive is now sufficient to assure that the diminishing of the setback requirement will, in no way impinge on the use, safety, or appearance of the road stem. Staff acknowledges that the right of way of the stem of Inglewood Drive is wider than necessary to accommodate the shared driveway. However, the fact that this is a corner lot with two front setbacks is not unique. Since staff is not able to find that the circumstances of the stem road qualify as a hardship, staff is unable to find that the hardship is unique. 2. This addition will increase the value to be more in keeping with those of Inglewood Court. Further, it should be noted that the property facing this proposed addition has had two additions of its own. Staff accepts the applicants'analysis. Further, the width of the right of way tends to increase the distance between the applicants'dwelling and the dwelling on the other side of the right of way. The proposed addition will be 27 feet from the edge of pavement. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. STAFF RECOMMENDATION: Since only one of the three criteria for approval has been met, staff can not recommend approval of this request. Should the Board find cause to approve this request, staff recommends the following condition: This variance is for the construction of the addition described in this file only. Any future additions or replacements will be subject to the setback and yard regulations at the time of application.
