Ladies and Gentlemen:
In response to your letter of September 8, 2000, please be advised of the following with
respect to the captioned Property:
1. The Property is zoned PD-MC, Planned Development Mixed Commercial and is
subject to the proffers and conditions contained in the approval of ZMA-96-03, a copy of which
is attached.
2. Final plan of development was granted on February 12, 1998 (and the landscape
plan in October and November 1998.)
3. The use of the Property for a four-story 83,088 square office building with
appurtenant parking facilities is a use permitted under the ZMA-96-03 approval and no special
use permit or variance is required.
4. The Property is in compliance with the Zoning Ordinance of Albemarle County,
including, but not limited to, all provisions regulating setback, density, parking and height.

5. All parking requirements for the Property have been satisfied as outlined in
Sections 4.12.6.6 through 4.12.7.7, copies of which are enclosed.
6. The Property is recognized as a separate parcel of land and may be conveyed,
leased, or mortgaged as a separate parcel. The Property has been divided subject to the
subdivision ordinance and is not subject to any other conditions or special limitations imposed by
the County of Albemarle in connection with any subdivision approval of the Property.
7. If destroyed under existing law, the Property could be rebuilt to the previously
existing size and shape on the same location with the same density conditions applicable.
8. This department has no record of any past or pending zoning violations with
respect to the Property.
9. A site plan amendment in the form of a "letter of revision" is pending to permit a
temporary emergency generator to be located in one of the two loading spaces on the north side
of the building, adjacent to the dumpster. It is our understanding that the tenant requiring the
backup system will be relocating to their permanent location in January or February 2001 and the
generator will be removed.

Dear Ms. McCulley:
I have been speaking with Me. Jan Sprenkle of your office in conjunction with
our request for an updated zoning letter. Ms. Sprenkle informed me this afternoon
that there was a nonconforming feature reported by the inspector; namely, a
generator located outside of the facility.
According to information furnished by a representative of the owner,
Broadstate Networks, a tenant of the owner, is temporarily occupying space in
Building One pending the completion of its space in Building Two. It has placed an
emergency generator outside of its space to provide additional power as the current
VEPCO grid does not supply sufficient power. Prior to placing the generator on the
premises, however, authorization was secured from an inspector with Albemarle
County (Mr. Gilbert) and Colonial Mechanical secured a permit for the generator a
well.

Broadstate Networks is scheduled to move into Building Two in January or
February of 2001. This is a temporary situation which will be remedied when the
move occurs.
Please consider this a request to modify the plan of development to permit
the generator to remain in place on a temporary basis. Should you need additional
information, please do not hesitate to call me.
