Hi Amelia,
Part of what has complicated this process for us, is that Judith, the one who restored this place for 4 years, had a
stroke &later died&her daughter was left to sell it. Apparently, the daughter didn't have access to information or
didn't want to share it with us. So, we have had to piece a lot of information together.
1. Do you know if the actual easement document includes language about
the line from your distribution tank to the septic field offsite, or access
you might have via a truck onto that property if it needed to be fixed? The
easement plat clearly shows the field. It just doesn't show the line from
your property to the field, or anything about access you would have to the
field on that property.
We had seen the lines drawn on a plat between our property& the septic field. We think that John Shepherd had
that plat(or something similar to a plat) when he met with us. We haven't seen that anywhere else since.
Apparently that plat isn't recorded in the Clerk's Office. The people that work at the Clerk's office verified that the
most recent plat recorded, was the one from 1991 & it didn't look as detailed or complete. As for access to the
field, we just assumed that a truck would drive up their driveway 7 across the field. We don't remember seeing
anything in writing that discusses this. All we see in our closing packet is "...property is conveyed together with
an easement for the purpose of installing and maintaining a drainfield for a septic system and for ingress & egress
to said system for the purpose of its installation &maintenance, as reserved in Deed from Grantor to John J.
Breznick, dated October 10, 2002, ..." We never went to look up the old easement from 1989 We could look into
that if it would be helpful.
2. Do you have anything in writing from the Health Dept? Since this
zoning regulation you're seeking variance to relates to maintaining
sufficient well &septic area, has the Health Dept put anything in writing
to confirm this for the Board of Zoning Appeals?
No, I don't believe we have anything in writing from the health department. As we were looking at the store, we
went to the health department&asked them if they had approved the well&septic for the store & the post office.
They said that it had been updated& that it was completed, but that the permit was still not closed(or something
like that). We made the completion/closure of the permit a condition of buying the store &our real estate agent
said that the sellers had to show us evidence of such. Sometime later our agent told us that sellers had to track
down the company that worked on the septic to get them to sign the paperwork for the health department. They
told us that they tracked them down & everything was officially taken care of, but come to think of it, I don't think
we ever had anything in writing from the health department. More recently, within the last week or so, Jan
Sprinkle told us that she had checked with the health department& they said that it was approved for the 3 uses,
including the store,post office & a 2 bedroom residence ... not a gas station or similar high traffic use.
Apparently, everything is in order, we just don't have it in writing from the health department. If it would be helpful
for us to obtain this, we'll get right on it. What do you think?
