We went to the Clerk's Office at the Courthouse. We investigated the plats &found out that the most recent plat that contains the septic/easement, behind our land, is from 1991. We photocopied this neighboring plat &took it to your office to be left in your box. It has the septic diagrammed by the surveyor. There is also a written mention of the easement on the plat. Before we purchased the building,we were told, that the easement was already on record & that nothing more needed to be done. Our purchase agreement states "The foregoing property is conveyed together with an easement for the purpose of installing & maintaining a drainfield for a septic system and for ingress and egress to said system for the purpose of its installation and maintenance, as reserved in Deed from Grantor to John J. Breznick, dated October 10, 2002, and recorded in said Clerk's Office in Deed Book 2291, Page 703,the location,terms and conditions of which easement are as set forth in a Deed of easement by and between Louise R. Johnson, et als. dated November 7,1989 and recorded in said Clerk's Office in Deed Book 1087, Page 314." Will the plat and/or these references suffice as proof of recordation? We just like to have something from the applicant in the file. and, yes, we changed to the 3 uses as soon as I discussed it with you -the legal ad has to be accurate or the hearing would have to be postponed to run the right information in the paper. That's a state requirement. As to the health dept, yes, and your site is fine - I talked to Bill Craun who checked the file and informed me that the system is on the adjacent parcel, but they don't have proof of recordation of the easement plat. That is one thing that we will require from you. If you have proof of recordation, please let me know the deed book and page number. We can check it provided it was recorded after 1-1-81. I'm guessing that it was recently recorded when the new system was installed (I think Bill said 1999?) If you have a copy of the plat with the deed book reference printed on it, that would also do. Just send us a copy. Bill said the system is large enough to handle the post office, a store that has rest rooms for employees (not a gas station which would have a lot of public restroom use), and a 2-bedroom apartment. There is sufficient area in the easement shown on the proposed plat for both the constructed system and a future reserve system. Once we receive the recorded plat, it will either verify that things were done as proposed, or that you will need to do something else Someone will probably be out looking at the site in the next day or two. We'll try to remember to email you so we can access the interior of the building and the apartment, if possible. We could email the revised description of request as a file to you or would you rather us revise it, print it out, & mail it to you? It is really only a few words that need to be changed. Since we wrote you last, we figured out how to access our variance request through the website. They have it down as 3 uses ... so it looks like it has already been updated.
