This is for aesthetic, structural, and historical reasons. We are not adding square footage through height increase,just changing the slope. In a renovation in the early 1920s, much of the architecture/slope of the original roof was removed. The current slope is nearly flat (less than 1 foot per 12 feet.) Our architect says it is "unviable, guaranteed to deteriorate, asking for trouble, etc" (The architect's name is Terry Cox, lives in Richmond, telephone (804) 783-8742). We are currently at a point of necessity in replacing the roof. We have several severe leaks at the moment, one of which is threatening the structure. Another reason the slope/height of the roof needs to be changed is that the "bearing plates" of the outside walls need to be adjusted. Approximately 95% of the structure is outside the 25 foot setback from VDOTs prescriptive easement and it is unclear whether the roof design currently will be going up higher in the area in question, but it may. (An engineer's sketch is attached, along with a fact sheet, that show a bird's eye view of the 25 foot border with VDOT's easement—whether we will ultimately increase vertical height inside of the 25 foot area is unclear.) JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. We need a new roof and a new roofline. The existing roof and roofline have been deemed not viable by both a structural engineer as well as an architect. In addition, the unnatural slope of the roof(less than 1 foot slope per 12 feet) has caused several problems, including the current leaks and structural deterioration 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. The grist mill was built around 1819 prior to the existence of the applicable Codes and regulations. In addition, it underwent an unfortunate renovation in the 1920's which greatly impaired the structure's integrity and aesthetic qualities, especially the roofline. Because of its former life as a working mill, it was placed unnaturally close to the road. However, the closest corner the road (after which it slopes away from the road quickly) is over 31 feet from the road. 3) That the authorization of such variance will not be of the substantial detriment to adjacent property and that the character of the district will not be changed by granting the variance. • The rural character of the North Garden area should not suffer and the mill will look much closer to its original lines We are spending a great deal of money and time on the aesthetic qualities so the construction will match the time period in which the mill was built, along with the rural character of the area(both of which are very important to us). Additionally, the mill is surrounded by several old growth trees which Will not be affected, but do screen the property from neighbors. Smith, PE, Civil Engineering, Inc. —April 03. Roudabush, Gale's physical survey in 1995 indicates the house dimensions of 48.4 feet by 36 8 feet exclusive of any porches. This calculates to be 1,781 square feet. Bob Coleman's limited survey in 2002 and Roudabush's survey confirms a distance of 31.6 or 31.7 feet, respective surveys, from the nearest corner of the house to the centerline of the road. That side closest to the road has a distance of over 50 feet at the other corner Bob Coleman spoke with Gerald Utz with VDOT today and after some discussion and some deed research Gerald said that we should use a 30 foot prescriptive easement along Route 692 (Plank Road). That means 15 feet left and right of the centerline. Using a 25-foot setback distance from this easement leaves us with an encroachment of 8 3 feet. (Keep in mind that the house was obviously built way before the easement was granted to VDOT - probably in the 60's). In terms of comparison with the house as a whole, I have calculated that the side most closely paralleling the road to be 17.7 feet of length within the 25-foot setback, or 36.6% of the total 48.4 feet of length.
