The property is in the Rivanna Magisterial District. The request is as follows: The applicant requests relief from Section 21.7.2 of the Zoning Ordinance to reduce the commercial setback for a structure adjacent to a residential zone from 50 to 37 feet to allow a roof to cover the proposed drive-in window. The subject portions of Tax Map 78, Parcels 12 and 12B are zoned R-15 Residential, with a pending rezoning to C-1, Commercial, and EC, Entrance Corridor.
