Request to increase the maximum wall sign area from 200 square feet to 386 square feet to allow 50 additional square feet of signage on the new building. TM 45 / Parcel 94B. zoned Hiahwav Commercial / Entrance Corridor overlay. t • DESCRIPTION OF REQUEST: Request that Colonial Auto Center be granted a variance, to allow an additional 50 square feet of wall signage to facilitate signage for our new Ni sc.an chnwrnrim facility Existing "Nissan" letters and logo will be removed from building at 200 Myers Drive . 4 JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. Colonial Auto Center is a single, unified parcel containing at least three separate business enterprises. A literal interpretation of the sign ordinance results in no signage for the Nissan sales facility, which is located in a new building. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. The above hardship is not shared generally by other retail businesses on Route 29 in Highway Commercial zoning. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Authorization of such variance will not be of any detriment to adjacent property owners as the proposed signs will be in conformity with existing signs both on the subject property and the property of adjacent property owners. The application may be deferred by the staff or the Board of Zoning Appeals, if sufficient information necessary to this review has not be submitted by the deadline. The permit was denied because it does not comply with the Albemarle County Zoning Ordinance. This will be explained more fully in the proceeding. As stated at the conclusion of this letter, a party aggrieved by this decision may appeal it. The current Zoning Ordinance, under Section 4.15.13 allows 200 square feet of wall signs per establishment. By ordinance definition, the business for which you are seeking wall signage consists of one (1) establishment. Your site currently has 379 square feet of wall signage; therefore, the current request for an additional 25 square feet can not be approved. If you are aggrieved by this determination, you have the right to appeal it within thirty (30) days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. In order for an appeal to be considered complete, it shall include a completed application and $120 fee. The date notice of this determination was given is the same as the date of this letter.
