I appreciate the opportunity to meet with Bill Dickie during my visit. I would like to thank him for providing me with a tour of the easement property. Please find enclosed for your records copies of the Stewardship Field Report, maps, and photographs from the recent site visit. I would also like to thank Mr. Dickie for speaking with me on October 3, 2013 regarding the proposed plans for the Peacock House. Based on the information we discussed, the plans to either remodel the existing Peacock House dwelling,or rebuild the Peacock House to a one-story 800 square foot dwelling located in the same approximate footprint location, are consistent with the easement. As a result of the recent division and conveyance allocations in 2012,the Plain Dealing Land Trust and Pheasant House, LLC easement property retains the right for subdivision into four parcels, five single-family dwellings and thirteen secondary dwellings. At least two of the secondary dwellings must be allocated to Tax Map Parcel 122-13A. Secondary dwellings are individually not to exceed 2,500 square feet of livable space. We appreciate your willingness to preserve open space and protect the rural character of the Virginia landscape. The Virginia Outdoors Foundation currently holds over 678,900 acres in open-space easements throughout the Commonwealth. In Albemarle County, over 65,000 acres are protected by such easements. Location: Albemarle County on Route 712 Zoning: RA Parcel 122-1 containing 302.52+/- acres We are requesting to waive the need for a site plan due to hardship. Hardship being the rigorous process of supplying a complete site plan with the cost and time to produce the site plan. The existing dwelling was built low to the ground allowing the floor joists and bottom of the walls to rot over time. The cost to renovate the existing structure would exceed the cost to remove and rebuild as new. We propose to: • Use the existing location for the new dwelling. • Replace the dwelling with a structure of the same use and similar size. The existing dwelling is 1,139 square feet with 2 bedrooms. We will be replacing this dwelling with a 2 bedroom or less structure of the same approximate size. • The utilities, site, and services supplied to the existing dwelling will be re used. o Domestic water is supplied from an existing well that serves the farm. The same water source will be used. o An existing septic system provides for the current dwelling. The existing septic will be checked to be reused for the new dwelling. It was repaired with new lines installed within the last 10 years. o Power is supplied from a remote meter that will remain the same for the new dwelling. o Access is provided by an existing paved driveway. The same access will be used. o Drainage for the existing dwelling will be modified slightly to improve drainage from the new structure. The area disturbed will be less than 10,000 square feet. o The new dwelling will require no additional streets, driveways, retaining walls, site lighting, easements, or significant site grading. • Follow all setback requirements. The existing dwelling follows all of Albemarle Counties current setback guidelines as will the new dwelling. • The current and proposed dwelling does not fall on any critical slopes. Owner has no current plans to further subdivide the property and the property has been placed under easement with the Virginia Outdoors Foundation to further preserve the property. Including the dwelling we are asking to replace there are currently 3 dwellings on this parcel. We are hoping to remove a dwelling in unsafe condition and replace it with a new dwelling built to current code compliance. The parcel (122-1) at 302.52+/- acres is easily large enough and the 3 dwellings are far enough apart to allow easy division allowing all required setbacks if the owner would choose to make those divisions. Parcel 122-1 has 5 division rights per Albemarle County. The use of the subject dwelling has been as a guest cottage and farm use cottage as it is in close proximity to the horse barns. Plain Dealing Farm is an active working horse farm. Objective: Our objective is show grounds for exception to a site plan section 32 due to hardship, and lack of necessity to produce site plan.
