This Termination Agreement made and entered into this 2 y — day of April, 2014,
by and between Gregory Cooley, Executor of the Estate of Victor F. Pascarella,
hereinafter called "Landowner" and the Board of Supervisors of Albemarle County,
Virginia, hereinafter called "County".
WHEREAS, Landowner is the owner of certain real property in Albemarle
County known as Tax Map 56 Parcel 112, as recorded in the land records of Albemarle
County in Deed Book 3136 page 79 and Deed Book 1888, page 344, hereinafter called
"the Property"; and
WHEREAS, Landowner and County entered into a Stormwater
Management/BMP Facilities Maintenance Agreement by instrument dated April 9, 2007
and recorded in Deed Book 3405, page 533; and
WHEREAS, the proposed final subdivision plat for the subdivision referred to as
Rolling Meadows and more particularly described in said Stormwater Management
Facilities Agreement was never approved and recorded; and
WHEREAS, the need for the Stormwater Management/BNP Facilities
Maintenance Agreement is no longer necessary and the parties have agreed to terminate
the agreement.
WITNESSETH:
THEREFORE, in consideration of the premises, the parties agree that the
Stormwater Management/BMP Facilities Maintenance Agreement dated April 9, 2007
and recorded in Deed Book 3405, page 533 is hereby terminated and of no effect.
