Applicant is requesting to amend conditions of VA-89-72 to allow a second wall sign. \qlr\ Description of Request: OCB RealtyCo. is requesting a variance for the installation of Z P q q g a 30" red sign on the south elevation of the building at 590 Branchlands Boulevard, CHARLOTTESVILLE, VA 22901 JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. The ordinance as it stands calls for the use of only one (1)wall sign on this building. The enforcement of the code greatly restricts the visibility of the building in terms of signage. The restaurant has experienced a dramatic decline in its sales. The sales have dropped by 40%. OCB as a corporation depends almost exclusively on its signage for advertising in the community. Needless to say the draw of customers from the surrounding area is greatly limited by having only one (1) sign on the building. We are requesting that this second sign be placed in the same location as the original sign installation. The total squre footage for the two signs combined will be 196. This is within the alloted 200 square foot maximum. At this point in time the viability of the business at this location is in question, hence the great hardship. 2)That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. The hardship in this location is unique in that the parcel is lower than the surrounding area. It is true in sign design that the faster the rate of travel on a road the higher the eyes of the driver go to search for signage and directional information. Due to this fact and given that the land is much lower than the surrounding roadways the situation is unique to this property and it is significantly different from other properties in the same vicinity. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. The authorization of the variance as requested would in no way be a detriment to the surrounding properties. The sign design as shown on the attached page shows a sign that was specifically designed to match the architecture of the building. The additional sign will in fact aid customers in the area in finding the restaurant and thereby lessen confusion on the part of the driver who is looking for the site. The design of the sign as mentioned is specific to this building style and thereby will in no way adversely affect the character of the district. The application may be deferred by the staff or the Board of Zoning Appeals, if sufficient information necessary to this review has not been submitted by the deadline.
