MEMORANDUM

SUBJECT: VA-2003-13 Diane and Randy Fox
DATE: December 22,2003
This Variance was deferred at the December 2,2003 meeting. The applicant was invited to provide
additional information to allow the Board to further consider the relationship of the location of the
proposed addition to the existing floor plan.The applicant was also invited to consider alternative
locations for the addition that would either reduce or eliminate the need for the variance.
The applicant has submitted the sketch plan showing the existing floor plan and the floor plan for the
addition.The sketch shows that the existing bedroom is in the portion of the house that encroaches into
the setback. The sketch shows that the proposed expansion of the existing bedroom is aligned with the
existing bedroom. One of the primary purposes of this addition is to enlarge this bedroom. It is the
applicants' opinion that the sketch demonstrates the original location of addition is in the most logical
location for the project and requests that the Board continue to consider the original proposal.Without the
variance allowing the addition to be constructed 6 1 feet from the property line,the enlargement of the
rear bed room will require a reconfiguration of the existing floor plan.
Staff agrees with the applicant that the alignment of the addition with the existing bedroom is a practical
and economical way to enlarge the rear bedroom. However this does not change the analysis of the
request contained in the staff report. It remains our opinion that this request does not meet the criteria for
a finding of hardship and that approval of the request would be a convenience to the applicant. The staff
report identifies additional factors for consideration that include the neighbors' support of the request,the
fact that the additon will be no closer to the right of way than the existing house and the fact that the
Nobel Lane only serves four dwellings.
