Please substitute this page for questions 4 and 5 on page two of the variance
application.
4) Description of Request: This variance is requested as the property line setback at the
time of purchase in 1978 was 20 feet. At that time the house was beyond the setback. (It
is now within the setback) The deck was built in 1986 with proper permits and
inspections with final approval. The variance should be granted as the footprint of the
house and attached deck area will not change with the proposed room addition.
5) Justification shall be based on these three (3) criteria:
1) That the strict application of this ordinance would produce undue
hardship. This is true as the owners require more living space and this is the
least expensive method of providing the additional space. All other methods
of adding living space would require many thousands of additional dollars and
would still be unsatisfactory.
2) That such hardship is not shared generally by other properties in the
same zoning district and the same vicinity.
This property is triangular in shape and as such the required 25-foot setback
produces a great deal of un-useable space on this property. On this one side of
the property, the calculation is 927.65 square feet. (255.53 feet less 50 feet
less 20 feet multiplied by 5 feet)
3) That the authorization of such variance will not be of substantial
detriment to adjacent property and that the character of the district will
not be changed by the granting of the variance.
The adjacent property will not be affected as the footprint of the house and
attached deck will not change with the proposed room addition. The proposed
enclosing of the deck is simply changing an outside room to an inside room
and living space.

I am the owner of the only adjacent property, in the Terrybrook
subdivision, to that of Mr. Karl E. Mason, who has applied for a setback
variance to his property for the purpose of changing his deck into a
family room.
In as much as Mr. Mason is not planning to change the footprint of his
house and existing attached deck area, I have no objections to the
variance being issued to Mr. Mason for the stated purpose and would
recommend the issuance.
