RE: Board of Zoning Appeals Action
VA-2003-014 - Tax Map 32F, Parcel 1B1
Dear Mr. & Mrs. Mason:
At their meeting on December 2, 2003, the Board of Zoning Appeals voted 3-1 to deny
the initial variance request to reduce the side setback from 25 feet to 17 feet, a variance
of 8 feet. (The request was to allow conversion of an existing deck to an enclosed
family room.) In addition, the Board approved staff's recommended "lesser variance" of
8 feet to allow the existing deck to remain as it is with the following condition:
• No enclosure of the deck or the area below it situated within the setback may be
permitted.
If you are aggrieved by this decision, you have the right to appeal it within thirty (30)
days of the date of the decision, in accordance with Section 15.2-2314 of the Code of
Virginia. If you do not file a timely appeal, this decision shall be final and unappealable.
An appeal shall be taken only by filing a petition specifying the grounds on which
aggrieved with the Circuit Court of Albemarle County within the prescribed thirty (30)
days.
