Hall, Owner/ Applicant TAX MAP/PARCEL: 32/67 ZONING: Heavy Industry - HI and Airport Impact Area - AIA ACREAGE: 4.154 LOCATION: 1949 Northside Drive TECHNICAL REQUEST AND EXPLANATION: The applicant requests variances from Section 26.10.2 that requires that no portion of any structure be located closer than 100 feet to a residential district. The variances are necessary to allow a records storage building to be located 30 feet and a parts storage building to be located 40 feet from Cedar Hill Mobile Home Park which is zoned R-4. These are variances of 70 feet and 60 feet respectively. Applicant's Description of Request: "We would like permission to locate a 12' X 16' parts storage building and a 14' X 26' record storage building within the 100' setback on the property commonly known as Hall's Auto Body, Inc. Each building is made of frame with painted wood siding and a 20- year shingle roof. The buildings are attractive and do not stand out from their surroundings. The buildings are built on skids and each is located on the asphalt within the fenced parking area. Neither of the buildings have electricity or plumbing." "We humbly request this variance for these two buildings so we can conduct our business in an efficient manner." RELEVANT HISTORY: There are zoning violations on this property. The storage buildings described in this application were located on the site without building permits and without the required amendment of the site plan. The site plan must be further amended to show two other storage buildings, parking lot striping, grading and fill and landscaping on the site that is not consistent with the site plan that was approved in 1998. The resolution of the matter of these two storage buildings will improve the situation but will not abate all zoning violations. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: This 4.154-acre parcel is the site of Hall's Auto Body, Inc. The owner now enjoys reasonable use of the property. It is staff opinion that this request does not meet the strict criteria required for a finding of hardship and that the granting of the request would be a convenience to the applicant. However, there are additional factors the Board may choose to consider in the analysis of hardship for this request. LIDEPTIBCZSI2004 staff reports/VA-2004-7 Hall.doc • The subject parcel which is zoned HI is adjacent to the Cedar Hill Mobile Home Park which is zoned R-4. Section 26.10.2 provides, in part, "For the heavy industry (HI) district, no portion of any structure, excluding signs, shall be located closer than one hundred (100) feet to any rural areas or residential district and no off-street parking shall be closer than thirty (30) feet to any rural areas or residential district." This is the largest setback required between districts in the ordinance. Clearly the intent is to protect residential and rural property from the impact of heavy industrial activities. In this case, it is staff opinion that the proposed activities associated with the storage buildings would not be characterized as heavy industry. Never the less, the ordinance makes no distinction between industrial and non-industrial uses of accessory structures and the 100 foot setback applies to all structures except signs, regardless of the use. The situation is exacerbated by the requirement of the building code that the main structure and the storage buildings be separated by a minimum of 20 feet because the exterior walls of the storage buildings are not fire rated. This effectively increases the setback by 20 feet plus the width of the building. The parts storage building was originally placed next to the main building. At the direction of the Fire Marshall the applicant moved the buildings to the other side of the parking lot, closer to the residential district. The proposed records shed is located in an area that appears to have been filled in a manner contrary to the approved site plan. This matter will be resolved in the course of abating the violations on the site. Staff acknowledges that the proposed location for the parts storage building makes good sense for the reasons put forth by the applicant. No such case has been made for the proposed location of the records storage building. Staff notes that the storage buildings are on skids, not permanent foundations. There are alternative locations on site for these buildings that would not require the approval of a variance. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: Hardship The applicant comments that the variance is necessary: "We need this parts storage building to be in close proximity to the parts receiving room entrance and the body shop entrance so the parts manager and the body technicians can readily retrieve parts as needed. If we have to relocate the building it would be difficult to control and use the parts storage building located on the opposite side of the 1.I DEPT1 BCZS12004 staff reportsWA-2004-7 Hall.doc 3 body shop. It would be a definite hardship for the parts manager to receive parts on opposite sides of the building from the same vendor. Also, the parts manager would have to unlock for each technician as they need parts through the work day. The parts stored in this building are the bulkier and heavier parts needed for collision repairs." It is staff opinion that the proposed locations of these storage buildings do not meet the criteria for a finding of hardship. As stated above, the applicant has reasonable use of the property and there are alternative locations available on the site for the proposed buildings. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant notes: "This hardship is unique to our situation in the auto collision industry and our particular body shop." Staff acknowledges that the ordinance does not provide relief from the 100 foot setback for non-heavy industrial uses on a site zoned HI adjacent to a residential district. Also, residential districts are commonly buffered from heavy industry by light industrial or commercial zoning which results in a reduced setback. However, since there is no finding of hardship, there can be no finding that the hardship is unique. 2. The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Impact on Character of the Area The applicant offers: "The two buildings we are requesting variances for are 70 feet (parts storage) and 110 feet (record storage) from the nearest mobile home. The buildings are located behind an eight foot high screened fence with heavy vegetation growing on the fence and large trees on the other side of the fence. Reasons of noise, traffic and bright lights for setback restrictions between commercial and residential zoning are not a factor here. The buildings have no electricity and placing and retrieving parts during working hours do not generate excessive noise levels. The traffic in the parking lot will be the same regardless of the location of these buildings." I:I DEP7IBCZSI2004 staff reports I VA-2004-7 Hall.doc 4 Staff, agrees with the Applicant's analysis. It is the opinion of the Planning staff that these buildings, as described in the application, will not adversely impact the adjoining residential property. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the granting of the variance will not change the character of the district. STAFF RECOMMENDATION: Staff finds that only one of the three criteria for the granting of a variance is met for this request and therefore recommends denial of the request. However, should the Board approve one or both of the proposed locations of one or both of the storage structures, staff recommends the following conditions: 1 . This approval is for the 12 foot x 16 foot parts storage building described in this application only; (If the BZA also approves the records storage building that must be included here.) 2. No paint, solvents, fuel or similar chemicals shall be stored in the building(s); 3. No lights shall be located on the exterior of the building(s); 3. No machinery equipped with back up alarms shall be used to move materials in and out of the building(s); 4. The existing chain link fence with woven screening tape or comparable solid screening must be maintained between the parking lot and the adjacent residential district. 5. The applicant shall obtain certificates of occupancy for both storage buildings; 6.
