RE: Board of Zoning Appeals Action
VA-2004-012 - Tax Map 20, Parcel 15B
Dear Mr. Burch:
At their meeting on August 3, 2004, the Board of Zoning Appeals voted 3-2 to deny
your variance request to reduce the front yard setback from 75 feet to 49 feet, a
variance of 26 feet to allow the construction of a 23 feet x 40 feet storage building on an
existing foundation.
I would like to make a correction on what was said at the meeting related to the
limitation on filing a new petition after original denial. After reviewing the State Code,
Zoning Ordinance and Board of Zoning Appeals By-Laws we found no limitation on
filing a re-submittal for a variance application.
If you are aggrieved by this decision, you have the right to appeal it within thirty (30)
days of the date of the decision, in accordance with Section 15.2-2314 of the Code of
Virginia. If you do not file a timely appeal, this decision shall be final and unappealable.
An appeal shall be taken only by filing a petition specifying the grounds with the Circuit
Court of Albemarle County within the prescribed thirty (30) days.
