Rh:: Variance request of 3'8" from property line for Barn style shed of 6'x8', (VA-2004-
14) Tax Map 60A I, Parcel 41A
Dear Ms. Sprinkle:
1 have attached a drawing for the placement of a Barn Style Shed 6'x8' using the side of
my property at 61 Court Place. In reading and trying to understand the zoning codes
18.34.1 pp 10:
"it states that when a property owner can show that his property was
acquired in good faith and where, by reason of the exceptional
narrowness, shallowness, size or shape of a specific piece of property, the
time of the effective date of this ordinance, or where, by reason of
exceptional topographic conditions or other extraordinary situation or
condition of such piece of property, _ . . ,
in my case (VA-2004-014) Tax Map 60A1, Parcel 41A was acquired in good faith in
1997; from 1998 through 1999 the County of Albemarle couldn't decide if they were
going to maintain this piece of public use (easement) property. Eventually, they decided
that it would be up to home owners that have the casement (which runs in the back of my
property and several neighbors) to maintain this area. After the hurricane last year they
came to evaluate the easement again and we were again informed that it is the
homeowner's responsibility to maintain this easement.
In your recommendation you have stated that property is useable property and has been
for the last 22 yeais. This is were I differ with you, this section of the property falls in
the topographic conditions, giving that I the dwelling has to be so far from the street and
the easement is more then twice the size of the dwelling, topographically 65-70%of the
property is easement or right-of-way. Therefore, there is a hardship of land use. This
request as you say is not a unique one, there again only four houses on this block have
this unique situation. Every other house has land use for making or obtaining a place to

store outside lawn/maintenancc materials for their yards and right-of-ways,but only four
of us are required by the County of Albemarle to maintain a detention water casement. A
piece of properly that was bought in good faith and where I feel that the Zoning Board
should really evaluate what I am trying to accomplish and to also to take in consideration
the times change and what was good (or looked to be good) may not be the best solution
now.
As the drawing shows I am asking for a variance of 3'8" on the side of the property for a
Barn style shed 6'x8' to be 2' away from the side of the house and 2%2' in front of the
step to the deck and approx. 18' from the drive way. This will allow for access to the
deck and mowing of the grass without infringing on my neighbors yard.
f request this variance in good faith and if given such special variance that it will be
maintained and strictly adhered to.
