4. Storage building(not permanently connected) on right side of property at 61
Court Place. I am requesting this hardship variance as approximately 1/3 of my property
is unusable do to the water easement held by the county. The easement prevents this
dwelling to have such a space to place this structure. Over the last two years I have been
renting a unit to keep lawn/garden equipment, chemicals used to maintain the growth of
the weeds and patio furniture during the winter. This expense has become financially a
hardship for me.
As one of the owners of property in the neighborhood I have been told by Albemarle
County authorities it is my responsibility to maintain up keep of the part of the
easement which is my property. With this unit it makes it easier for me to do such a task.
I am able to keep the chemicals outside needed to kill the weeds, the mower to cut the
grass and the other equipment needed to maintain the yard and the easement.
If there was no easement(1/3 of the property with a 20foot drop which is unusable
space for me) I would not have this hardship and obtaining a permit for this building as I
would have a backyard and the structure would fit within the necessary parameters of the
lot.
5. 1) As I mentioned above I need a place to store the mowers, weed-eaters, gardening
chemicals, yard equipment and patio furniture. And if this easement was not in its
present location,I would have a nice backyard as some of the other neighbors have.
Having the structure does not put a burden on me to transport equipment needed to
maintain my yard or the easement.
2) The properties at 59 Court Place and 63 Court Place are used by the property
owners as rental property and they have had people come in to take care of there
properties. I do not have these kinds of funds for such assistance and I am the sole
person to maintain the property 61 Court Place.
3) If anything the property value will rise and I will end up paying more taxes to
Albemarle County. The structure is not an eyesore and is and will be well maintained.
