This project has received a Special Use Permit (SUP) to construct a new Head Quarters for Kappa Sigma Fraternity, formerly located on Rt . 250 W. This facility will include a museum for fraternity records and artifacts, an administration ' area for approximately 20 staff, and a Chapter Room for fraternity ceremonies . From the onset of this project, it was Kappa Sigma' s desire that the facility be constructed such that the Chapter Room be located on its own level, above the Administrations area. Their intentions have consistently been to construct a 3- story building, because this best accommodates their programmatic and ceremonial needs . The desired image for this project is a grand estate, not unlike the Head Quarter' s previous facility on Route 250 west . We have received a staff recommendation for a final Certificate of Appropriateness from the Architectural Review Board, and are hopeful for approval soon. During the County' s final Site Plan Review, staff informed us that though the 2-story west elevation does meet the ordinance' s 35' maximum height limitation, the 3-stories of the east elevation exceeds the maximum height limit . . This project is extremely time-sensitive, because the Fraternity was unexpectantly required to vacate their previous facility due to unsuccessful litigation with the Fraternity' s ' foundation. In order to meet the Owner' s schedule requirements, we believed it would be critical to identify the parameters and requirements of the project as early as possible . From the beginning of this project, we met with the County regularly for discussions and reviews of the design (both formal and informal) . We received comments on these occasions, but the County never indicated, either verbally or in writing, that the building height was an issue until we received the phone call on September 1, 2004 . This was only days before we were expecting to get final site plan approval, and only a month before construction is slated to begin on the project . A timeline of the reviews and written comments provided by the County is as follows : Reviews with Albemarle County December 22 , 2003 - Submitted SUP Application. Site plan and section (see Attachment "A" ) with scale show building over 50' tall . February 5, 2004 - Receive written SUP review comments from County, including Zoning. February 13 - Informal review with County staff . February 23 - Submitted to ARB with 1/8" elevations (see Attachment "B" ) . March 16 - Working Session with Planning Commission and staff (Margaret Doherty) : 1/8" scale Elevations presented. April 5 - Architecture Review Board' s review and approval of conceptual design. April 22 - Meeting with County Building Inspector to review building code issues . April 27 - Hearing with Planning Commission - SUP recommendation passed. May 10 - Site Plan working session with County staff . May 12 - B.O. S. Hearing - awarded SUP; Kappa Sigma proceeds to finalize purchase of the land based upon county approval of SUP and building design. May 24 - Final Site Plan submitted; height of building written on cover page as 54 ' (see Attachment "C" ) . June 15 - received County comments - no objection to height noted on cover page (only note to "show dimensions for each building on C- 6 . Clearly, the County had numerous opportunities to indicate that the building height of the design approved for the SUP and for the Architecture Review Board' s Certificate of Appropriateness was not acceptable . However, this never occurred until months after construction documents were nearly finished and the Owner had spent well over a million dollars on property acquisition and professional fees . The existing property has a considerable slope, which results in the east side of the lowest floor being at grade . What could be considered as a 2-story building with lower level therefore appears to be a 3-story building on the east side . Due to the orientation of the topography, it is unfortunate that this taller east elevation faces Route 20 . Although the east elevation has an entry on the lower floor, it is only intended for the occasional museum visitor. The entry on the west elevation is the primary entrance where most people will enter the building on a day-to-day basis . This entrance is nearest the parking area and accesses the main floor level , where the building' s daily occupants are located. Therefore, we believe the west elevation, containing the primary entrance, could be considered the "front" of the building, and the building could be modified to meet the 35' maximum height limitation if measured in this location. The staff has indicated that only the east elevation can be considered the "front" . Because of the depth of floors necessary to accommodate structure and mechanical systems, a 35' height requirement on the east elevation would effectively limit the building to a main level with walk- out basement . Neither the desired image nor the program of the Fraternity would be accommodated with this reduction in floors and height . In order to meet the Fraternity' s schedule requirements, construction must start in early October of 2004 . Failure to meet this schedule will jeopardize the fraternity' s ability to build on this site, as will requiring the east elevation to be reduced to 35' in height . The orientation of the slope results in a bias against the design of what is essentially a 2-story building with walk-out lower level on one side . That is, if the topography were high at the front of the site and sloped down towards the rear of the site, then the current design could meet the 35' height requirement . However because of the slope up front-to-back on the site the tallest elevation faces Route 20 . Secondly, the east elevation complies with the spirit , if not the letter, of the ordinance . As noted above, the intent is to create a headquarters that appears like an estate and programmatically functions to meet Kappa Sigma' s needs . On this sloping site, only a two story structure, as entered from the west, can accomplish this . The site continues to rise behind the building such that the existing hill and trees will be a visible backdrop for it (see Attachment "D" ) . The building will therefore not be seen in profile against the sky, and so it will appear less dominant and be less visible . There are many similar estates in Albemarle County (such as Mirador, Redlands, Estouteville, Morven, and others) which exceed 35' in height . Furthermore, there is an exception to the 35' maximum height which allows agricultural museums and farm structures to exceed 35 ' . The intent of limiting height seems to be to maintain the look of what might be expected in a rural/residential area. Our museum is not "agricultural" , but it is located within a structure which will have the appearance of a grand estate, and will be in keeping with the surrounding area. The variance would not be a substantial detriment to adjacent properties . Additional Considerations This property is in a designated growth area, and this project resonates with the intent for new growth in this area . It could be seen as an improvement over other potential developments . The Kappa Sigma Headquarters will generate minimal new traffic, and its appearance will be in keeping with the estates which line Route 20 between Scottsville and Charlottesville advancing the rural/residential character of Route 20 . 2325/Admin/104Code/104.2RegAgency/4-23-04Schlothauer Another significant consideration is that this project is in the County' s interest and for the public good. As part of the conditions of the SUP, Kappa Sigma has agreed to extend public water and sewer from a point roughly one half mile north to this site .
