feet S. of inter. with Solomon Road. TM 061K/P 09-1, zoned Highway
Commercial. Applicant requests amendment to VA 96-10 to correct the side
setbacks (which were both varied from 50 feet to 35 feet) to reflect a new
survey. The new request will vary the ,north side setback to only 40 feet
and extend the south side to 20 feet. \qlr\

AMENDMENT TO VARIANCE REQUEST VA-96-10 (SETBACK REQUIREMENT)
DESCRIPTION OF REQUEST: Variance is requested for two side yard
building setbacks. The existing structure pre-dates these setback
requirements and extends beyond the fifty foot setbacks. Therefore
when enclosing the existing runs the structure necessarily extends
beyond these setbacks . At the NE corner we request a 15 foot exten-
sion and at the SW corner a 30 foot extension is required. This
would then allow expansion to occur in a rectangular fashion with
respect to the existing structure.
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
To expand along the required building setback lines causes the
architecture to produce oblique angles which are difficult to build,
inefficient and without reason with respect to the existing
building.
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
Adjacent properties are not zoned Highway Commercial and there-
fore do not have Lhe same iequiiemef Lb.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
This variance will not cause detriment to the adjacent property
and will allow the expansion to be more efficient and
aesthetically pleasing.
The application may be deferred by the staff or the Board of
Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.
