RE: Response Letter #1 for SUB202100157, Bamboo Grove - Final Subdivision Plat
Dear Cameron,
Thank you for your review of Bamboo Grove. This letter contains responses to comments dated
November 10, 2021. Our responses are as follows:
Required changes:
1. [ZMA201900016] Per proffer 42 of ZMA201800019, affordable housing units are
required if more then two lots are going to be subdivided. Please indicate on the plat
which units/lots will be provided as affordable units and indicate whether they will be
rental units or for -sale units
RESPONSE: On Sheet 1, Note 4 of the Subdivision Notes Section has been added, which
states, "Lots 3 and 4 shall be designated as for -sale affordable dwelling units pursuant to
ZMA2019-16."
2. [ZMA201900016] Per proffer 43B of ZMA201900016, the dedicated of the 0.22-acre
open space area and construction of the trails within it must be dedicated to the County
prior to the third certificate of occupancy for the project. The developer may dedicate the
0.22-acre area with the final plat creating the new lots. Is this the intent of the developer?
If the dedication will not occur with this final plat, the 0.22-acre area should be labeled as
"hereby reserved for future dedication to Albemarle County for public use."
RESPONSE: The intent is to dedicate the trail area to the County with the final plat. The label
has been changed to "10-foot pedestrian access easement hereby dedicated to Albemarle County
for Public Use, 0.12 Ac." The acreage does not exactly match what was shown in the
ZMA2019-16 concept plan, but this is allowable pursuant to Section 313 of the Proffer Statement,
which states, "The Owner shall dedicate and convey to the County, upon demand by the County,
approximately 0.22 acres labeled as "Trail Dedication" on the Concept Plan (the "Trail
Dedication Area"). The precise location of the Trail Dedication Area shall be mutually agreed
upon by the Owner and the County, and such agreement shall not be unreasonably withheld or
conditioned" (emphasis added). The trail is in the same general location as that shown in the
Concept Plan, except it has now been platted with the benefit of precise survey data.
3. [14-302 (13)(1)] Please add a date of last revision.
RESPONSE: A revision date has been added to the Subdivision Plat.
4. [14-302 (13)(5)] Please revise Note 5 on Sheet 1 so that it states that the properties are
zoned R4 and are subject to the proffers of ZMA201900016. Note 16 can be combined
with Note 5.
RESPONSE: On Sheet 1, Note 1 of the Subdivision Notes Section states, "Parcels are zoned R4
Residential and are subject to proffers of ZMA2019-16 dated July 28, 2020."
5. [General Comment] Delete note 912 on Sheet 1. Properties in the development areas
do not have development rights
RESPONSE: Note 12 referencing development rights has been deleted.
6. [14-302 (A)(4) & 14-302 (A)(5)] Please state whether the pedestrian access easement is
public or private in the easement label on Sheet 3. If public, a deed of dedication will be
required to be recorded with the plat.
RESPONSE: The pedestrian access easement will be public. The easement label has been
revised accordingly. A deed of dedication will be recorded with the plat.
7. [14-302 (13)(9)] Please add a note to Sheet 1 stating that Lots 1-6 each contain a building
site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance."
RESPONSE: On Sheet 1, Note 3 of the Subdivision Notes Section states, "Lots 1-6 each contain
a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance."
8. [14-302 (13)(8)] Please add the minimum and maximum setbacks as a note on Sheet 1.
Consult Section 4.19 of the Zoning Ordinance for these setback standards.
RESPONSE: The Subdivision Notes Section on Sheet I has been revised accordingly.
9. [14-303 (N)] Please add a note to the plat stating "The streets in this subdivision may not
meet the standards for acceptance into the secondary system of state highways and will
not be maintained by the Virginia Department of Transportation or the County of
Albemarle."
RESPONSE: The note has been added on Sheet 1, Note 1 of the VDOT Notes Section.
10. [14-311] Prior to final plat approval, Water Protection ordinance (WPO) plan must be
approved. Please contact the Engineering Division directly for WPO related questions.
RESPONSE: Noted.
11. [14-311, 14-410, 14-412, 14-422] Prior to final plat approval, road plan application must
be approved. Road plans are currently under review, application number SUB202100159.
RESPONSE: Noted.
12. [14-316] Please see attached VDOT comments. All VDOT comments must be addressed
prior to final plat approval.
RESPONSE: Noted.
13. [14-317] Instruments evidencing maintenance of certain improvements required as part of
the final plat approval. The instrument must address all requirements specified in
subsections of Section 14-317 of the Subdivision Ordinance. Features that require
instruments identifying ownership and maintenance responsibilities are as follows:
a. The proposed private street. A private street maintenance agreement template is
attached. Please complete the template and the associated checklist (attached).
Submit these items with the revised plat, and they will be forwarded to the County
Attorney's office for review.
RESPONSE: Noted.
14. [14-400] Please add a note to Sheet 1 stating that the lots proposed will meet R4 Bonus
Level Cluster Development standards in accordance with the approved ZMA application
plan.
RESPONSE: Please see Note 2 of the Subdivision Notes Section on Sheet 1.
15. [14-302 (A)(13), 14-414 and 14-430] ACSA approval required prior to final plat
approval. Revisions to proposed ACSA easements may be required, pending completion
of ACSA review of the plat.
RESPONSE: Noted.
16. [14-431] All proposed public stormwater and drainage easements will require a deed of
dedication to be recorded with the plat. Deed templates will be drafted by Engineering
Division staff and provided to the applicant once all substantive revisions to the plat have
been addressed. Please contact the Engineering Division directly for questions related to
stormwater and drainage easement deeds.
RESPONSE: Noted.
17. [14-434 and 14-435] Prior to final plat approval, all on -site improvements required by the
Subdivision Ordinance must be completed (built) or bonded. This includes stormwater
management facilities, drainage facilities, and streets.
RESPONSE: Noted.

18. [Sec. 14-202.1] Provide owners notarized signature when final copies are submitted for
County signature and approval.
RESPONSE: Noted.
Comments from Other Reviewers:
Albemarle County Engineering Services (Engineer) — John Anderson — Requested changes,
see attached.
WP02021-00042 plan resubmittal received 10/13/21, must be approved prior to final
subdivision.
RESPONSE: Noted.
2. ROAD plan, SUB2021-00159 must be approved, and roads built or bonded prior to final
subdivision.
Note 1: Engineering review comments for road plan sent to Applicant 10/27/21.
Note 2: Engineering intends to comment on revised WPO plan within one week.
RESPONSE: Noted.
Albemarle County Information Services (E911) — Elise Kiewra, ekiewra@albemarle.org — No
objection, per site plan date 8/20/2021.
Albemarle County CDD Inspections — Betty Slough, ekiewra@albemarle.org — See
recommendations.
Add the following note to the general notes page: All water, sewer and fire lines require
NEW inspection and testing procedures. The ACSA performs any testing inspections of
the public sewer and water main(s). The Albemarle County Building Inspections
Department (ACRID) does a visual inspection and witnesses to the testing of the building
drain, water service pipe and sprinkler lead-in connection. The developer/contractor is
responsible to retain a Special Inspector as outlined in the updated Albemarle County
Policy for Site Utilities to perform the visual inspection and testing of all utilities not
covered by the ACSA or ACRID. This includes building sewers, water, and fire line
branches between the main and the meter(s)/building(s). The Special Inspector's report
must be submitted and approved by the Albemarle County Engineering Department prior
to a Certificate of Occupancy being issued.
RESPONSE: Please see Notes 1-4 of the ACSA Notes Section on Sheet 1.
2. Add the following note to the general notes page: Where the flood level rims of plumbing
fixtures are below the elevation of the manhole cover of the next upstream manhole in the
public sewer, the fixtures shall be protected by a backwater valve installed in the building

drain, branch of the building drain, or horizontal branch serving such fixture. Plumbing
fixtures having flood level rims above the elevation of the manhole cover of the next
upstream manhole in the public sewer shall not discharge through a backwater valve.
RESPONSE: Please see Note 5 of the ACSA Notes Section on Sheet 1.
3. Note to developer: due to required distances from lot lines and structures as required by
the NFPA, underground propane tanks may be prohibited. Plan accordingly.
RESPONSE: Noted.
Fire and Rescue — Howard Lagomarsino — No objection.
Parks — Tim Padalino — No objection.
Virginia Department of Transportation — Adam I Moore, revisions requested.
1. Please include a note stating, "VDOT will only maintain within drainage easements to the
extent necessary to protect the roadway from flooding or damage."
RESPONSE: Please see Note 2 of the VDOT Notes Section on Sheet 1.
2. Please include a note stating, "Landscaping plants and trees adjacent to the sight distance
triangle will need to be maintained in area between 2 and 7 feet above ground as a clear
zone to preserve sight lines and accommodate pedestrians. The HOA will be responsible
for the maintenance of sight lines."
RESPONSE: Please see Note 3 of the VDOT Notes Section on Sheet 1.
