[ZMA201800019] Per proffer #2 of ZMA201800019, access easements must be provided to TMP 046134-00-00- 005A0 and TMP 03200-00-00-029D0. These access easements should be provided where proposed private streets connect to these two adjacent parcels. a. Planning staff is working with the County Attorney's Office to obtain a template for the private access easement agreement. This may be a separate deed that will need to be recorded with the final plat, or it may be in some other form of instrument. The instrument template will be provided to the applicant at a later time once it has been drafted. Rev. 1: Comment stands. Staff correspondence with applicant via email on August 4eh informed applicant that the County Attorney's Office has stated that the property owner is responsible for drafting private access easement agreement per the proffer. No draft of the easement agreement was submitted with the second submittal of the plat. Please provide a copy of the draft with the next plat submittal, and include a completed version of the attached checklist. 2. [14-302 (A)(8)] Please label the open space parcel adjacent to the street entrance onto Proffit Road on Sheet 2. State the acreage of the open space parcel. Rev. 1: Comment addressed. 3. [14-302 (B)(1)] Please add a date of last revision. Rev. 1: Comment stands. 4. [14-302 (13)(5)] Please revise Note A on Sheet 1 so that it states, "AIA Airport Impact Area Overlay District." Rev. 1: Comment addressed. 5. [14-302 (13)(8)] Please add the minimum and maximum garage setbacks to the setback note on Sheet 1. Consult Section 4.19 of the Zoning Ordinance for these setback standards. Rev. 1: Comment addressed. 6. [14-303 (H) and 14-421] Please fill in the blank in Note 2 on Sheet 1. Rev. 1: Comment addressed. 7. [14-303 (L) and 14-431] Please see attached Engineering Division comments. Some drainage easements and stormwater easements that are currently labeled as private will actually need to be public. Please revise the easement labels accordingly. Rev. 1: Comment not fully addressed, see attached Engineering Division comments. 8. [14-303 (M)] Please see attached E911 comments. Plat must state all proposed street names prior to approval. [14-303 (N)] Please add a note to the plat stating "The streets in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle." Rev. 1: Comment addressed. 10. [14-303 (S)] Please see attached Engineering Division comments regarding required control points. Rev. 1: Comment addressed. 11. [14-311] Prior to final plat approval, Water Protection ordinance (WPO) plan must be approved. Please contact the Engineering Division directly for WPO related questions. Rev. 1: Comment addressed, WP0202100017 is approved. 12. [14-311, 14-410, 14-412, 14-422] Prior to final plat approval, road plan application must be approved. Road plans are currently under review, application number SUB202100124. Rev. 1: Comment stands, road plans (SUB202300124) not vet approved. See attached Eneineerine Division comments for further information. 13. [14-316] Please see attached VDOT comments. VDOT is requiring that the final site plan for this project, SDP202100008, be approved prior to final plat approval. VDOT approval of entrance onto public streets is required prior to final plat approval. Rev. 1: Comment addressed, see attached VDOT approval. 14. [14-317] Instruments evidencing maintenance of certain improvements required as part of the final plat approval. The instrument must address all requirements specified in subsections of Section 14-317 of the Subdivision Ordinance. Features that require instruments identifying ownership and maintenance responsibilities are as follows: a. All open space parcels to be owned by the HOA. b. All private easements, including the proposed private street easements. c. If the applicant will provide a draft of HOA covenants to cover these items, the County Attorney's office has asked that the applicant complete the HOA Covenant checklist that is attached to this comment letter. Submit a copy of the completed checklist with the draft covenants, if applicable. Rev. 1: Comment stands. Applicant comment response letter states "Noted." In response to this comment. No drafts of deeds of easement or private improvement maintenance agreements were included with the submittal of the revised plat. 15. [14-400] Please update note 8 on Sheet 1 so that it identifies whether this is a Standard level Cluster Development, or a Bonus Level Cluster Development. Rev. 1: Comment addressed. 16. [14-302 (A)(13), 14-414 and 14-4301 ACSA approval required prior to final plat approval. Revisions to proposed ACSA easements may be required, pending completion of ACSA review of the plat. Rev. 1: Comment addressed, see attached ACSA approval. 17. [14-431] Please see attached Engineering Division comments. All proposed public stormwater and drainage easements will require a deed of dedication to be recorded with the plat. Deed templates will be drafted by Engineering Division staff and provided to the applicant once all substantive revisions to the plat have been addressed. Please contact the Engineering Division directly for questions related to stormwater and drainage easement deeds. [14-434 and 14-435] Prior to final plat approval, all on -site improvements required by the Subdivision Ordinance must be completed (built) or bonded. This includes stormwater management facilities, drainage facilities, and streets. Rev. 1: Comment not fully addressed. Area Land Use Engineer Charlottesville Residency VirginiaDOT.org WE KEEP VIRGINIA MOVING Review of Private Improvement Maintenance Instrument (Albemarle County Code § 14-317) RE: SUB Identify the specific provision(s) of the proposed Private Improvement Maintenance Instrument that meet each of the following requirements of Albemarle County Code § 14-317(A: 1.Identify the plat to which the instrument applies; if the plat has been recorded, the identification shall include a deed book and page number. 2. State that the improvement will be maintained in perpetuity. 3. State that the improvement will be maintained to a standard that, at a minimum, ensures that it will remain in substantially the condition it was in when approved by the county if the improvement was installed prior to the agent signing the plat or the condition it is to be in when the surety was released as provided in section 14-436; for a private street, shared driveway, or alley, the instrument also shall state substantially as follows: "The travelway shall at all times be maintained so that it is safe and convenient for passenger automobiles and emergency vehicles at all times except in severe temporary weather conditions." 4.If the instrument pertains to the maintenance of one or more private streets, alleys or shared driveways, it shall define "maintenance" by stating substantially as follows: "For purposes of this instrument, `maintenance' includes the maintenance of the private streets or alleys, and all curbs, curbs and gutters, drainage facilities, utilities, dams, bridges and other private street improvements, and the prompt removal of snow, water, debris, or any other obstruction so as to keep the private street or alley reasonably open for usage by all vehicles, including emergency services vehicles." 5.Describe the condition of the improvement when it was approved by the county if the improvement was installed prior to the agent signing the plat or the condition it is to be in when the surety was released as provided in section 14-436. 6.Identify the timing or conditions warranting maintenance of the improvement. 7.State a means to collect funds necessary for the cost of maintaining the improvement; at a minimum, the means stated shall include the right of any landowner subject to the instrument to record a lien against a non-contributing landowner, to bring an action at law to collect the funds, or both. 8.Describe how maintenance costs will be prorated among the landowners subject to the instrument (e.g., "equally," or on a percentage basis); if any lot within the subdivision may be further divided, the instrument shall also describe how maintenance costs will be prorated among the landowners after division. 9. State substantially as follows: "No public agency, including the Virginia Department of Transportation and the County of Albemarle, Virginia, will be responsible for maintaining any improvement identified herein."
