Houff (applicant) Request reduction of front setback from Rockfish Gap Trpk from 75 to 45 ft to allow construction of a dwelling. Property is located on the south side of Rt. 250, approx. 400 feet west of its intersection with Rt. 824. Tax Map 55, Parcel 19A, Zoned Rural Areas. The following information shall be submitted with the application and is to be provided by the applicant: 1) Recorded plat or boundary survey of the property requested for the rezoning. If there is no recorded plat or boundary survey,please provide legal description of the property and the Deed Book and page number or Plat Book and page number. 2) The appropriate drawings showing all existing and proposed improvements on the property,with all dimensions and distances to property lines,and any special conditions on the property that may justify the request. 3) Fee payable to the County of Albemarle. 4) Description of Request: Please see marked survey for proposed setting of house,well, septic system, and drain field. Request variance from edge of property to front of house from 75 foot standard setback to 45 feet. Request variance of drain field to be allowed on a 27 percent slope at western end of property as shown on survey. 5) Justification shall be based on these three(3)criteria: 1) That the strict application of this ordinance would produce undue hardship. This is an unusual parcel in that it is split in two pieces. To require that the 75 foot setback be strictly adhered to would pose undue hardship as to place the house any further back would be to encroach upon a steep 90 percent slope. 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. This parcel is grandfathered as it is a pre-1980 parcel of record. It is exempted from the building site provision of ordinance. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. The character of the district will not be changed as the adjoining properties are a landscape market, a flood plain(corn field)and a church.
