HomeMy WebLinkAboutVA200500008 Review Comments 2005-12-06 (2) STAFF PERSON: John Shepherd PUBLIC HEARING: December 6, 2005 STAFF REPORT VA-2005-008 OWNER/APPLICANT: Ada and Vernon Cobbs TAX MAP/PARCEL: 57/61 A ZONING: Rural Areas- RA ACREAGE: 2.089 LOCATION: East side of Browns Gap Turnpike approximately 0.9 mile north of the intersection with Route 250. TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance from Section 10.4 which requires a minimum 75 foot set back from a public road right of way in the RA district. The applicant requests a variance of 45 feet to allow the construction of a dwelling that would be 30 feet from the right of way of Browns Gap Turnpike. RELEVANT HISTORY: This parcel was created prior to the effective date of the Zoning Ordinance. Building Permit 2004-4869-SF was issued on September 30, 2004. This permit showed a house on the southern portion of the parcel and the drain field located to the north. The permit was revised and reissued on July 7, 2005. This permit was for a 2-story dwelling on a basement located on the northern portion of the parcel with the drain field located to the south. The plat showed the dwelling was to be located 80 feet from the right of way of Browns Gap Turnpike. Since that time substantial clearing and grading has occurred on this site. A portion of the prepared building pad is located within the 75-foot front setback. The grading created fill slopes that exceed 2:1. PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: The majority of this parcel beyond the 75-foot front setback contains slopes ranging from 25% to 50%. Section 4.2.6 (b) permits the construction of one single family dwelling on critical slopes on lots created prior to December 10, 1980 provided there are no alternative sites outside of critical slopes. In this case, it is staff opinion that the excessive slope on this parcel meets the standard of an exceptional topographic condition that is required for a finding of hardship. Construction of a dwelling on this slope would be very challenging from an engineering perspective and would result in significant disturbance of the critical slope which is expressly not in harmony with the zoning ordinance which provides for the protection of such slopes. This request is complicated by the clearing, excavation and grading that has recently occurred on this site. The building site was made more level by cutting near the road and filling on the area of steep slope. Portions of the new fill slopes exceed 2:1, the maximum County standard. The building pad that is shown on Thomas Lincoln's drawing encroaches into the front setback. The rear portion of the pad is composed of fill. The contractor who performed this work is no longer employed by the owner of the property. I IDEPTIBCZS12005 staff reportslVA-2005-008 Cobbs.doc 2 The applicant proposes to construct a 1,324 square foot dwelling on a full basement with a 528 square foot garage. The southwest corner of the house will be located approximately 65 feet from the right of way, in the existing corner of the graded pad. The northwest corner of the house will be located approximately 31 feet from the right of way. The northwest corner shall be located at least 175 feet from the "T-Post" shown on Thomas Lincoln's drawing. This location will prevent any further harm to the trees located to the south and southwest of the house site. The pivoting of the northern end of the house towards the road will allow the worst of the impact caused by the filling on the existing critical slopes to be mitigated. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: (Staff comments are written in italics and follow the applicant's.) Hardship The applicant comments: Strict application would almost render the lot unbuildable. The length of frontage on Route 680 is 553 feet. The area within the 75-foot setback is 41,575 square feet of 48% of the lot. The well and septic requirements add more constraints. It is staff opinion that enforcement of the 75 foot setback, forcing the structure onto the critical slopes, constitutes an undue hardship. 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant notes that new lots do not have this problem because developed lots are 3 to 5 acres larger. This lot was possibly recorded before the 75 foot setback was required. Staff verifies that this parcel was created prior to the establishment of the building site and 75-foot setback requirement. Staff further finds that the small percentage of area outside of the setback on slopes of less than 25% slope qualifies this property as unique. 2. The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. I:IDEPTIBCZS12005 staff reportslVA-2005-008 Cobbs doc 3 Impact on Character of the Area The applicant offers that seven other structures within one half mile of the property have structures that are less than the required 75 foot setback. Staff generally agrees with the applicants'assessment as it pertains to development patterns along Browns Gap Turnpike. However, approval of this request will have a certain impact on Parcel 5C3, which is located directly across the road from Parcel 61A and whose entrance is near the proposed house site. It is staff opinion that the proposed location is reasonable. The alternative house site at the southern portion of the parcel would be difficult to develop at this stage because the well has been installed there in accord with the approval from the Health Department. Also, it may be difficult to install the drain field on the portion of the site that has been graded. The house site could be adjusted somewhat to the south away from the driveway for Lot 5C3. However, this would stress two oak trees, one of which is 18 feet from the proposed house site. 3. The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the granting of the variance will not change the character of the district. STAFF RECOMMENDATION: Since the three criteria for approval of a variance have been met, staff recommends approval of this request with these con itions: 1. This variance is for the construction of the dwellin as described in this file only. f Any future additions or replacements will be subjec to the setback and yard regulations in effect at the time of application.
