HomeMy WebLinkAboutVA200500008 Correspondence 2005-12-05 December 5, 2005 To the Board of Appeals: I am here today to strongly object to the granting of a set- back variance on Browns Gap Tpke next to the Beaver Creek Dam Reservoir. The excessive degree slope involved much of the property prior to the logging operation and the terracing. There was a great deal of earth disturbance with little precaution taken to keep eroding soil from running into the Mechums River, which is perhaps 200 feet from the property's ESE line. I do not feel that any permits Should have been issued in the first place. Since the enactment of the Chesapeake Bay Preservation Act, plus the adoption of protective measures starting back in the 1970's, the County has been committed to preserving buffers on local streams and rivers that feed the public water empoundments. If you grant this exception, you will be setting a serious precedent that will threaten all steep, forested slopes and the quality of the County's water resources. The northwest corner of the house will be located approximately 31 feet from the right of way. Please confirm that my understanding is correct. Thanks. FIRST By rotating the north end (the garage end)toward State route 660 to 31 44 feet off the road easement, the garage aligns better with the existing drive cut and positions the garage end on solid ground, not non compacted fill dirt. This reduces a lot of land disturbance SECOND: This realignment allows the home to slip approximately 10 feet northward in the existing hole (previously excavate) so the south end disturbs no more tree root systems or vegetated areas when connecting to the septic field area and back filling. THIRD: Previous excavation removed 12"oak s along the frontage on 660 that could have been saved with out difficulty. The buffer was obviously wiped clean for construction convenience. The present requested offers better opportunity to correct previous poor site planning. The repositioning lessens the barren space between the garage and the road A few well placed small conifers or perennials between the garage and the road would help restore the buffer that was needlessly ripped out. FOURTH: By better aligning the house foot print with the natural land contour, the rear"cliff' created by pushing the dirt off could be re contoured closer to the original hill side so it's not as steep. This make less drainage problems on the hill side, allows solid ground area for the rear porch footings, and makes the home nestled better to the natural land contours which helps in final grading, greatly improves the home's final appearance and cuts land disturbance by 50 to 70%. FIFTH: Mr Cobbs lot has a very long frontage and with the current setback almost 50% of the land is setback. This is unusual.
