With this letter, I'll list the outstanding required information as well as what staff recommends, prior to this variance request proceeding to the Board of Zoning Appeals (BZA). • (Required) — Building Setback Requested In order for the variance to be heard by the BZA, we need to know the minimum proposed building setback from both Route 240 and Route 680. The variance application you submitted only lists a variance from Route 680. As I mentioned to you by phone, the approved site plan also relies on a variance from Route 240. Because the prior site plan has expired and the new building proposal may differ, the resulting building setback may also differ. The legal advertisement for a variance request needs to be complete (the second setback variance from Route 240 if needed, must be mentioned) and it needs to be exact (exactly how many feet back from the two road rights-of-way will the proposed building be located?). We don't want to review and potentially approve a variance which must then later be amended to provide what you need to build your proposal. • (Recommended) — Parking Setback Request In addition, I advise that you seek a parking setback so that it is not left as a nonconforming setback. Left only as a nonconforming setback, over time with no approved use of the property, the nonconformity could be lost. In that event, all parking would need to meet a 10 foot setback and parking on this property would be eliminated. In order to obtain a parking setback, you will need to revise the variance application to list that request with the setback distance you are seeking, as well as to provide justification for the request. • (Recommended) — Preliminary Conference with the ARB Because this property is located on two Entrance Corridors (Route 240 and Route 250) and you are seeking to build closer to those roads, I suggest that you obtain ARB review of your proposal. While you may not obtain actual approval at this time, Melton McGuire —VA-2C )09 April 25, 2006 Page 2 it would only benefit your variance request if they do not object. One of the variance criterion relates to the impact of a proposal on the character of the area. The impact on the Entrance Corridors is directly relevant to that criterion. Because the prior site plan and ARB approval have expired, the prior building plan approvals are not relevant. In addition, you are changing those plans by this variance request. This variance request can not be scheduled until we have the accurate and complete information about the building setback you are requesting. If this is not submitted to us by May 1st, the variance will not be heard on June 6th. Any submittal later than May 1st will follow the variance deadline for filing schedule for the meeting date. Please also be advised that John Shepherd has informed me that he will not be able to issue your parcel determination until you submit an additional $80. You can either mail that or drop it by.
