ATTACHMENT A
Justification for the contemplated variance on Tax Map 57 Parcel 31A is:
1. Strict enforcement of the setback requirement in conjunction with the Water
Protection Ordinance(WPO) would generate a hardship so severe that it
approaches a taking by the County. This is property is a grandfathered Cl
commercial property located in the Rural Area. Prior to adoption of the WPO,the
property owner had a right to expand the facility in any number of ways that
complied with all other County regulations.
During 2004,the Zoning Administrator made a series of determinations the last of
which was dated February 2, 2005. These determinations included an
interpretation of the WPO that limited the existing building to its current footprint
of 3,960 square feet. This finding coupled with the setback requirement for Rt
680 meant that no expansion is possible.
Prior to the February 2, 2005 interpretation of the WPO, it was possible to
increase the area of the structure. After the WPO is applied, no expansion is
possible. If allowed to stand,this application of the WPO is tantamount to a
taking of otherwise grandfathered rights.
We suggest that the best solution is to permit a second story over the existing
footprint. This is no currently possible because the Rt. 680 setback only applies
to the first floor.
2. We are unaware of any property as heavily impacted by the WPO as this property.
In fact,this may be the most constrained commercial property in the entire
county.
3. Authorization of this variance will have no impact on the neighboring properties.
A setback variance for Rts. 680 and 240 currently exist for the property.
Consequently, the requested variance will not impair visibility for traffic. Two
level structures are permitted in the area and common. No party is adversely
impacted by the proposed variance.
