To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned C1, Commercial. The Property is subject to ZMA2005-
00010, approved June 7, 2006, with proffers. The permitted uses of the Property
are provided in Section 22 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property is subject to the Airport Impact Area and Entrance
Corridor Overlay Districts described in Section 30 of the Zoning Ordinance.
• The Property is subject to site plan SDP200800096 "Wachovia Bank & Shops
at Rio Road - Minor," the most recently approved site plan associated with
the Property. It appears the Property has been developed in accord with
these approved plans.
• The existing use of the Property for retail/ restaurant and other uses customarily
accessory and incidental thereto is permitted.
• The Property is not subject to density regulations as dwellings are not permitted.
• The two streets the Property front do not have specific designations for commercial
frontage. The Property is zoned and has been developed to allow access from both Rio
Road (Rt 631) and Seminole Trail (US Rt 29).
• The current zoning setback requirements are identified on the noted site plan, and are
measured from the righ-of-way from the public streets.
• There are no adjacent properties zoned Residential.
• No application for rezoning of the Property, or for a special or conditional use permit or
variance in connection with the Property, is now pending.
• There are no outstanding building or zoning violations on file associated
with the Property.
