VA-2006-005 (Sign # 1), Kevin or Julie Oh (owners/applicants). Request reduction of
the rear setback from 20 to 17 ft to allow an existing deck to remain. Property is located
on the cul-de-sac of Towne Lane, Village Square subdivision. Tax Map 61A, Section 5,
Parcel 18, Zoned R-4, Residential.
The following information shall be submitted with the application and is to be provided by the applicant:
1) Recorded plat or boundary survey of the property requested for the rezoning. If there is no recorded plat or boundary survey,please
provide legal description of the property and the Deed Book and page number or Plat Book and page number.
2) The appropriate drawings showing all existing and proposed improvements on the property,with all dimensions and distances to
property lines,and any special conditions on the property that may justify the request.
3) Fee payable to the County of Albemarle.
4) Description of Request:
Zoning variance to allow a deck encroachment into the rear set-back allowance of 2 feet.
5) Justification shall be based on these three(3)criteria:
1) That the strict application of this ordinance would produce undue hardship.
This condition has existed since our townhome was built in 1997. We purchased the property in 2004 not knowing that a certifcate
of occupancy was never issued by the county. The county realized there was no CO and notified us in March 2006.
2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
This situation is unique to the three units in our building as our units are the only ones with basements and decks. All other units in Village
Square Phase III have ground level patios which do not have to meet set-back requirements. This situation was created by the builder and
allowed to continue by the county since the units were built.
3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the
district will not be changed by the granting of the variance.
The property has been like this for 9 years and granting the variance will not change the character of the district. The character of the distract would
change if the variance is not granted and we have to cut off a portion of the deck,as it will then be out of proportion with the structure
