Shifflett TAX MAP/PARCEL: Tax Map 9, Parcel 2 ZONING: Rural Areas- RA ACREAGE: 2.710 LOCATION: 1537 Simmons Gap Road The property is located on the northeast side of the road approximately 0.5 miles mile from its intersection with Markwood Road. TECHNICAL REQUEST AND EXPLANATION: The applicant requests a variance of 4 feet from Section 4.11.2.1 to allow an accessory structure (detached carport) that was built 2 feet from the side property line to remain in its existing location. The required setback is 6 feet. RELEVANT HISTORY: The detached carport was constructed under Building Permit-, 10 5 2002-1198-NNR which was approved on July 2, 2002. The plat submitted with the i 00 i= building permit indicated the carport was to be constructed 100 feet from the front and ACi'c 'f 10 feet from the side property line. A final zoning inspection was performed on February Z• 15, 2006. The work was rejected because the posts of the structure were found to be 3 CAS feet from the side. It was inspected and rejected again on May 26, 2006 for the same reason. During the second inspection the zoning inspector advised the owner that the 2--IS" 06 eave must also meet the setback. The eave is approximately 2 feet from the side '-2.4-06 property line. A Notice of Violation for the carport was issued on July 14, 2006. The 2 ejec,fod property is the subject of other zoning complaints that are under review. i„ly I4,t o o 6, Nov PROPERTY DESCRIPTION AND QUALIFYING CONDITIONS: The property is improved with a dwelling, and four accessory structures: a building containing most of the features of a dwelling, two other sheds and the detached carport that is the subject of this variance request. One of the three findings the BZA must make under Virginia Code § 15.2-2309(2) and Albemarle County Code § 34.2 in order to grant a variance is the finding that the strict application of the ordinance would produce an undue hardship. Undue hardship exists where, because of a condition of the property or adjacent property: (1) strict application of the ordinance effectively prohibits or unreasonably restricts the use of the property; or (2) without a variance, there is a clearly demonstrable hardship approaching confiscation. It is staff opinion that the applicant has reasonable use of his property and therefore, does not meet the test for a finding of undue hardship. APPLICANT'S JUSTIFICATION AND STAFF COMMENT: A review of the variance criteria provided by the applicant and comments by staff follows: Staff comments are written in italics and follow the applicant's comments. A building permit was issued for it. It isn't but two feet from being compliant with the code. It would cost me a lot of money to move it just a few feet. I am up in age and I need this building for my storage." It is staff opinion that the owner has reasonable use of his property and that the denial of this request in no way approaches confiscation of the property. Therefore, this request does not meet the criteria that are required to support a finding of hardship. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship. Uniqueness of Hardship The applicant did not respond to this criterion. Staff is unable to find that this hardship is unique because no hardship has been identified. 2. The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Impact on Character of the Area The applicant offers, "I do not feel that this is causing any harm to the other land owner." The adjacent land owner has requested that this application be denied. She indicated in a phone conversation that the carport is too close to her property line and that she thought it should follow the rules. Based on that comment, it is staff opinion that the granting of this variance will be of substantial detriment to the adjoining parcel, Tax Map 9, Parcel 2C. 3. The applicant has not provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance.
