The Plat and both the SWIM Easement Deed and the Public Drainage Easement Deed have been signed and approved.
Your copies are in the bin in the lobby of the Community Development Department for pick up. Please be aware that the
County Office Building is still only open to the public on Mondays, Wednesdays, and Fridays.
Please see Andy's message that I have printed and stuck with the documents. The SWM management deed needs to be
recorded first with the Plat followed by the Drainage Easement deed.

Hi All,
To further clarify, I am awaiting a revised version of the Stormwater Management Access Easement Deed. The Public
Drainage Easement Deed I have and it has been signed by the County Executives office. The SWM Access Easement Deed
was never revised to my knowledge, or at least I never received the revised version. Once I receive the revised version of
the SWM Access Easement Deed I will confirm with the County Attorney's office that it is ready for signature and will
have it signed by the County Executives office. Once both of those deeds are signed the Plat will be approved and all
three (Plat, SWM Access Deed, and Drainage Deed) will be recorded together. The Stormwater Management
Agreement, not to be confused with the Easement, is a separate agreement that I believe is handled by the Engineering
division along with the WPO process.

My best attempt to clarify:
There are 2 deeds. There is a plat of Bobler Engineering, dated September 4, 2020, last revised April 2, 2021.
- County attorney's office mentions signed drainage deed; please let me know ( internal recipients) who has this signed
drainage deed (signed by CAO/County executive).
- Second, Brandy, yes, it would be helpful to have your client return signed /notarized SWM deed —can you assist, help
shepherd the process?
- SWM deed to be signed by PT Hotel is attached to Carla Harris email sent to Brandy Booker, 10/13/2021 9:31 AM —
one original SWM deed is sufficient.
- Recommend once the SWM deed is signed /notarized that it be transmitted (mail /hand -delivered ) with cover to Kevin
McCollum, that states: `Not for review, for signature approval.'
- I am glad to serve as alternate recipient, would be glad to route SWM deed for CAO/Executive signatures, if helpful, if
transmittal cover is addressed to me.
- If original copies ( x 2) of signed -notarized plat has not yet been submitted, please include two (2) originals with SWM
deed; same recommendation for transmittal ( `Not for review... )
- With not all involved at every stage, we regret the confusion and delay.
- It appears we have a county -approved drainage deed ( signed by applicant, signed by county, just want to locate); but
still need to receive original (revised) signed /notarized SWM deed of dedication.
- It appears we may also need 2 original easement plats, signed /notarized by Applicant.
I am familiar with process, just not all the details, status or location of documents in this instance —am glad to assist Kevin,
any way I can.

September 4, 2020, last revised April 2, 2021, entitled "Plat Showing B
Consolidation, Vacation and Dedication of Various Easements Over TMP #0780(
06400 and TMP #07800-00-00-06500 Pantops" (hereinafter, the "Plat"), a copy c

Note: If read email attached to email, instructions relating to recording SWM deed of dedication prior to public drainage
deed relates to specific language in first Whereas paragraph, p. 1, of each deed. SWM deed states `plat attached hereto,'
while drainage deed states 'plat, a copy of which is recorded immediately prior hereto.' Order of recordation, by applicant,
once county -approved original plat and both deeds are returned, is: SWM deed with plat; then, immediately, Public

Hi Everyone,
I believe there are two deeds that need to be recorded along with the Plat for SUB202000169. A SWM agreement and
deed of dedication. It sounds like the County Attorneys office has signed the deed of dedication, but has asked for
revisions to the SWM agreement. We were reaching out for an update on the SWM to see if those revisions they had
asked for had been incorporated and resubmitted yet.
Without having any of these in front of me I may be confusing the two, but that is how I understand it.

I believe there are two deeds that need to be recorded along with the Plat for SUB202000169. A SWM agreement and
deed of dedication. It sounds like the County Attorneys office has signed the deed of dedication, but has asked for
revisions to the SWM agreement. We were reaching out for an update on the SWM to see if those revisions they had
asked for had been incorporated and resubmitted yet.

Hi All,
To further clarify, I am awaiting a revised version of the Stormwater Management Access Easement Deed. The Public
Drainage Easement Deed I have and it has been signed by the County Executives office. The SWM Access Easement Deed
was never revised to my knowledge, or at least I never received the revised version. Once I receive the revised version of
the SWM Access Easement Deed I will confirm with the County Attorney's office that it is ready for signature and will
have it signed by the County Executives office. Once both of those deeds are signed the Plat will be approved and all
three (Plat, SWM Access Deed, and Drainage Deed) will be recorded together. The Stormwater Management
Agreement, not to be confused with the Easement, is a separate agreement that I believe is handled by the Engineering
division along with the WPO process.

I'm sensing confusion in this exchange. To my knowledge, there are four documents for this project,
three of which we already have and only one of which we still need:

1. SWM agreement for Parcel 78-64 (recorded at DB 5449, page 708)
2. SWM agreement for Parcel 78-65 (recorded at DB 5566, page 116). (Both SWM agreements pre -date
10/14/2021 and do not require further action.)
3. Fully -executed drainage deed - delivered to and held by Kevin
Don't (Yet) Have / Still Need
4. SWM deed - I actually made suggested changes back on September 20. For whatever reason, that revised
version was not the one that the applicant initially signed. We now need the attached correct version
signed.

Received, thank you. A second SWM Agreement was required for this site as the second parcel number was left off this
first Agreement when prepared. It was previously sent to the client for execution (see attached email and PDF), and it
was my understanding the owner submitted the agreement to the County for final approval and execution. Can you
please confirm you have record of this being recieved, or if I need to have the owner re -execute the attached PDF?

Hi All,
To further clarify, I am awaiting a revised version of the Stormwater Management Access Easement Deed. The Public
Drainage Easement Deed I have and it has been signed by the County Executives office. The SWM Access Easement Deed
was never revised to my knowledge, or at least I never received the revised version. Once I receive the revised version of
the SWM Access Easement Deed I will confirm with the County Attorney's office that it is ready for signature and will
have it signed by the County Executives office. Once both of those deeds are signed the Plat will be approved and all
three (Plat, SWM Access Deed, and Drainage Deed) will be recorded together. The Stormwater Management
Agreement, not to be confused with the Easement, is a separate agreement that I believe is handled by the Engineering
division along with the WPO process.

- County attorney's office mentions signed drainage deed; please let me know ( internal recipients) who has this signed

- Second, Brandy, yes, it would be helpful to have your client return signed /notarized SWM deed —can you assist, help

- SWM deed to be signed by PT Hotel is attached to Carla Harris email sent to Brandy Booker, 10/13/2021 9:31 AM —
one original SWM deed is sufficient.

I believe there are two deeds that need to be recorded along with the Plat for SUB202000169. A SWM agreement and
deed of dedication. It sounds like the County Attorneys office has signed the deed of dedication, but has asked for
revisions to the SWM agreement. We were reaching out for an update on the SWM to see if those revisions they had
asked for had been incorporated and resubmitted yet.
Without having any of these in front of me I may be confusing the two, but that is how I understand it.

I believe there are two deeds that need to be recorded along with the Plat for SUB202000169. A SWM agreement and
deed of dedication. It sounds like the County Attorneys office has signed the deed of dedication, but has asked for
revisions to the SWM agreement. We were reaching out for an update on the SWM to see if those revisions they had
asked for had been incorporated and resubmitted yet.

To further clarify, I am awaiting a revised version of the Stormwater Management Access Easement Deed. The Public
Drainage Easement Deed I have and it has been signed by the County Executives office. The SWIM Access Easement Deed
was never revised to my knowledge, or at least I never received the revised version. Once I receive the revised version of
the SWM Access Easement Deed I will confirm with the County Attorney's office that it is ready for signature and will
have it signed by the County Executives office. Once both of those deeds are signed the Plat will be approved and all
three (Plat, SWM Access Deed, and Drainage Deed) will be recorded together. The Stormwater Management
Agreement, not to be confused with the Easement, is a separate agreement that I believe is handled by the Engineering
division along with the WPO process.

I believe there are two deeds that need to be recorded along with the Plat for SUB202000169. A SWM agreement and
deed of dedication. It sounds like the County Attorneys office has signed the deed of dedication, but has asked for
revisions to the SWM agreement. We were reaching out for an update on the SWM to see if those revisions they had
asked for had been incorporated and resubmitted yet.
Without having any of these in front of me I may be confusing the two, but that is how I understand it.

final two copies of the Plat for signature as well. Once the Plat has been signed please record the drainage easement

Andy Herrick had told me to hold off on approving the Plat and recording the drainage easement deed until the SWM

I just had a conversation with Andy Herrick and he suggests that we re -send the attached deeds back to the Applicant
for signature with his suggested revisions. In summary, the signed deeds and plats came in for final County approval and
I sent them over to the County Attorney's office for signature and that's when Andy noticed the deeds did not include
the revised language. Could you all please revise the language and get these back over to the applicant for signature as

Attached are the completed review comments for applications SDP202000004 Hampton Inn Final Site Plan ("Final Site
Plan") and SUB202000169 Hampton Inn Final Plat ("Final Plat"). The Final Plat will need to be approved and recorded
prior to the approval of the Final Site Plan and the WPO Plan. However, there appears to be some outstanding ACSA
comments that need to be addressed that will impact the Final Site Plan resubmittal and the Final Plat. It sounds like
ACSA needs their Final Site Plan comments addressed and utility alignment confirmed before they can approve the Final
Plat. So, it sounds like the major issues need to be resolved with ACSA before resubmittal of both these plans. I have
copied Engineering and ACSA on this email if you have any questions.

effective on May 16, 2016, and Flood Insurance Rate Map ( "FIRM") most recently amended February 6, 2017—hope this

We use separate deeds for public drainage and SWM facilities, so item 3. requests public drainage easement label/s distinct
from SWM facility easement label. The SWM facility easement for detention need only encompass the UG facility. Pipe
outfall from the SWM facility, beyond the SWM facility easement, should be labeled public drainage easement.
May 16, 2016 traces to county ordinance. Even if date of a specific FIRM panel for a particular project was not revised May
16, 2016, since Albemarle County FIS was (ordinance, below), Planning has determined that floodplain notes should reference

Please ensure plan table reference and proposed max. grade are consistent, wherever they appear in the plan. There is only one
max. grade. Use max. grade and ACDSM, p. 15 easement diagram below to calculate easement width. Note: diagram includes
whatever stone depth is proposed; we understand the point that stone would not be required to be maintained for system
operation, but unless this (1.5' x 2 =) 3' additional easement width proves impossible, please reference the diagram, as
shown. If additional 3' easement width is (physically?) impossible, then easement width may reference bottom of pipe rather
than base of stone. Thanks.

confirm this easement with you.
Min. Easement Width = ADS System Width (21.2') + (7' x 2) + 10' (equipment landing) + 2' = 47.2'.
The Proposed Elevations table references the Max. Allowable Grade above the system as 518.75', however per the
proposed grading the max. grade over the system is only 516.5'. (516.5' — 504.5' = 12' ... 12'-5' = 7'). While the easement
was computed with the system base elevation at 504.5' to be conservative, the bottom of the ADS system used for 5WM
is 506.00' and the additional 1.5' of stone is provided for structural support and wouldn't be required to be maintained
for system operation.
Please let me know if you accept the easement as shown (attached) and we will finalize for resubmission.

During review of plat, I noticed that the proposed easement width for the ADS system is insufficient; this affects
WP0201900047 linework on several sheets. Image below is from C202 but appears on C901 as well. Using easement width
diagram from p. 15 of Albemarle County Design Standards Manual (ACDSM, link below) Min. easement width = ADS system
width (21.2') + (9.25' x 2) + 10' (equipment landing) + 2', or 51 T. 9.25' derives from C-902 Proposed Elevafion table, first
and last rows, which are entries for bottom of stone (504.50') and Max. allowable grade (top of pavement
/unpaved)(518.75'). Difference in table values is 14.25' and if consider ACDSM easement diagram, below, this means 9.25'
easement width to each side of (parallel with) ADS system, to allow 1:1 side -slope excavation (OSHA/trench
safety). Reviewing WPO plan -view sheets, easiest and perhaps only way to gain necessary easement width (bare minimum) is
to show SWM facility easement at face of curb behind the hotel, and, on the other side, —I' from back face of Wall 4. This will
be a principal plat review comment; this comment does not affect or alter hotel layout, require computational design, or involve
any other design feature, beyond easement linework across final site plan (SDP202000004), WPO plan (WPO201900047), and
BLA/easement plat (SUB202000169). I regret missing this with earlier WPO/SDP plan review comments, yet it's important. If
SWM facility easement linework is adjusted to appear in approximate locations shown by blue lines in snippet below (and
continuing around the ADS system), Engineering will not object. We recognize proposed easement width is insufficient for the
moment, should ADS UG system need to be replaced. Again, sorry for late request for site, WPO, and (now) plat

During review of plat, I noticed that the proposed easement width for the ADS system is insufficient; this affects
WP0201900047 linework on several sheets. Image below is from C202 but appears on C901 as well. Using easement width
diagram from p. 15 of Albemarle County Design Standards Manual (ACDSM, link below) Min. easement width = ADS system
width (21.2') + (9.25' x 2) + 10' (equipment landing) + 2', or 51 T. 9.25' derives from C-902 Proposed Elevafion table, first
and last rows, which are entries for bottom of stone (504.50') and Max. allowable grade (top of pavement
/unpaved)(518.75'). Difference in table values is 14.25' and if consider ACDSM easement diagram, below, this means 9.25'
easement width to each side of (parallel with) ADS system, to allow 1:1 side -slope excavation (OSHA/trench
safety). Reviewing WPO plan -view sheets, easiest and perhaps only way to gain necessary easement width (bare minimum) is
to show SWM facility easement at face of curb behind the hotel, and, on the other side, —I' from back face of Wall 4. This will
be a principal plat review comment; this comment does not affect or alter hotel layout, require computational design, or involve
any other design feature, beyond easement linework across final site plan (SDP202000004), WPO plan (WP0201900047), and
BLA/easement plat (SUB202000169). I regret missing this with earlier WPO/SDP plan review comments, yet it's important. If
SWM facility easement linework is adjusted to appear in approximate locations shown by blue lines in snippet below (and
continuing around the ADS system), Engineering will not object. We recognize proposed easement width is insufficient for the
moment, should ADS UG system need to be replaced. Again, sorry for late request for site, WPO, and (now) plat

Good morning John,
We've been coordinating internally on different project items but are now preparing for resubmission and I wanted to
confirm this easement with you.
Min. Easement Width = ADS System Width (21.2') + (7' x 2) + 10' (equipment landing) + 2' = 47.2'.
The Proposed Elevations table references the Max. Allowable Grade above the system as 518.75', however per the
proposed grading the max. grade over the system is only 516.5'. (516.5' — 504.5' = 12' ... 12'-5' = 7'). While the easement
was computed with the system base elevation at 504.5' to be conservative, the bottom of the ADS system used for SWM
is 506.00' and the additional 1.5' of stone is provided for structural support and wouldn't be required to be maintained
for system operation.
Please let me know if you accept the easement as shown (attached) and we will finalize for resubmission.
