Dear Mr. Perez;
Re: Comments to be addressed with the Final Subdivision Plat Approval:
7. [14-302(A)(14) & 14-314] Land to be dedicated in fee or reserved; Identification of all interests of the County in
property. Revise the label for the area to be dedicated for Route 743 to include the wording "to be dedicated to the
County for public use." Also, revise note #10 to include the same wording. Final. Throughout note #10 remove the
portion of the note that reads "to the Comm. Of Va" for the various easements being dedicated, as these
easements are only being dedicated to the County not to the Commonwealth of Virginia. Additionally,
throughout note #10 omit the wording "to be dedicated to the County for public use", and instead replace it
with "is hereby dedicated to the County for public use". Additionally, ensure the note provided on sheet 2 is
revised utilizing 1125' from the Ctr is hereby dedicated to the County for public use."
Note 10 was revised to read as follows: 10. TM 45-59M is subject to an easement for
overhead electric lines (no width given, along Rte 743, 35' east of its center line
and 300' long) to the Virginia Public Service Company as recorded in DB 232-395
(Dominion Energy, 1860 Commerce Road, Richmond VA 23224); and is subject to an
easement for a guy stub & anchor on VEPCO Pole A-131X as recorded in DB 272-456
(Dominion Energy, prior address); and is subject to an easement for overhead electric
& telephone lines (no width given, at a location to be designated by VEPCO) to VEPCO
as recorded in DB 284-298 (Dominion Energy, prior address); and is subject to a 20,
ease. for overhead telephone lines (adjoining Rte 743) to Va. Tel. & Tel. as recorded
in DB 314-179 (Sprint, 6200 Sprint Parkway, Overland Park KS 66251). Bella Signature
Homes, LLC is hereby dedicating the Public Drainage Easements (0.028 Ac. & 0.019 Ac.)
to the County of Albemarle for public use together with required drainage ditches.
Bella Signature Homes, LLC is hereby dedicating 25' from the center of Rte 743 (0.327
Ac.) into the property, & the 54' R/W for Olivia Court (1.352 Ac.), and the VDOT
Sight Easement (0.018 Ac.) to the County of Albemarle for public use together with
required drainage ditches. The sight easement areas shown on Sheets 2 & 3 were
established by surveying a 500' long line of sight from the center of the VDOT entr-
ance for Olivia Court at 14.5' off the edge of the pavement for Route 743 to the
center of both lanes of approaching traffic. Clearing is required for 5' into the
property from those established sight lines. They extend to the edge of the 30,
prescriptive easement on Rte 743 for TM 45 Parcels 59C & 59E1 and to the edge of the
0.327 acre road dedication for TM 45 Par. 59M (Lot 1). A deed from Joseph Huff and
the Knicely's to the County of Albemarle for public use will be acquired to cover the
sight easements (0.035 Ac. & 0.017 Ac.) required by VDOT on their properties. Those
easements are agreed to by Joseph Huff and the Knicely's as notarized on Sheet 3. The
SWM Facility Easements (U.LSs Ac. & 0.020 Ac.) and the SWM Forest & Open Space
Easement (6.72 Ac.) will be managed i.a.w the Alb. Co. Water Protection Ordinance.
The SWM Forest and Open Space Easement is subject to the guidance set forth by DEQ in
the VA Stormwater Management Program. The areas will remain undisturbed in a natural,
vegetated state, except for activities as approved by the local program authority,
such as forest management, control of invasive species, replanting and revegetating,
passive recreation (e.g., trails), and limited bush hogging to maintain
desired vegetative community (but no more than four times a year).
8. (14-302(A)(5) & 14-303(L)] Public easements; Public utility, drainage and sight distance easements Address the

deed of easement for the drainage easements. Please note: A template for this deed will be provided to you
during the final plat review process. Final. Comment partially addressed. Submit a draft deed of easement
or the public drainage easements (attached is a template). County Attorney review/approval is required
prior to final subdivision plat approval.
Per this note and the request for separation of public drainage & SWM easements by
Emily Cox on 11/27/2019: Public drainage & SWM easements were separated & shown on
Sheets 2, 3, & 4 (with their acreages corrected on the plat and in Note 10 above) on
the plat dated 1/31/2020. Mr. Luke Kitelinger is having a draft deed of easement
prepared which will be submitted for the final review.
Additionall Sheet 2 notes relevant to dedications to the county were revised (due to
plat spacing) as follows:
- For the pre-existing 25' dedication from TM 45 - 59L: "25' From The Center Of Route
743 Was Dedicated To The Co. Of Alb. For Public Use For TM 45 - 59L. Ref: DB 619-220
Plat"
- For the new 25' dedication from TM 45 - 59M: "25' From The Ctr. Hereby Ded. To The
County For Public Use. Ref: Note 10."
- For the new 54' road dedication for Olivia Court from TM 45 - 59M: "1.352 Ac. Is
Hereby Dedicated To The County For A 54' R/W For Public Use"
13. [14-303(N)] Statement pertaining to private streets. If a private street is not approved note #11 must be edited
appropriately. Final. Remove note #11 as it is no longer necessary nor applicable because the road is a public road.
15. [14-303(R)] Parent parcel access. Provide the following note: "All subsequent division of the residue shall cuter only
onto such streets) shown on the approved final plat and shall have no immediate access onto to any public street."
Final. Comment not addressed. The ordinance requires the note regardless of future development potential.
To address Notes 13 & 15: Note 11 was removed and replaced with "All subs�,__.,t
division of the residue shall enter only onto such street(s)shown on the approved
final plat and shall have no immediate access onto any (I inserted the word "other"
here) public street."
18. [14-308.1, 17-10031 Groundwater assessment information. Final Tier 3 groundwater management plan must be
approved prior to approval of final plat. Final. Comment still relevant. A Tier 3 groundwater management plan
was not submitted with the final subdivision plat. Please submit the plan for review and approval.
Mr. John Anderson emailed the need for well tests on 12/16/2019 to Mr. E. Beasley
before a final version of the Tier 3 groundwater management plan could be approved.
These will be done prior to the final review.

19. [14-309 & 14-3101 Soil evaluations & Health director approval of well and septic systems
VDH approval was forwarded by Chris Perez on 12/31/2019.
20. [14-311, 14-434 & 14-4351 Infrastructure improvement plans; Completion oton-site improvements required prior to
plat approval; Agreement and surety. Road Plan and WPO Plan must be approved, all required improvements must be
built or bonded, and all required Deeds and Declarations must be reviewed and approved prior to Final Plat approval.
Final. Comment still relevant. Road Plan and WPO Plan have been approved. All required Deeds and
Declarations must be reviewed and approved prior to final subdivision plat approval. Please provide the draft
deed of dedication for the sight distance easement (attached is a template). County Attorney review/approval is
required prior to final subdivision plat approval.
Mr. Luke Kitelinger is having drafts of deeds and declarations prepared and is
working on the bonding of road and WPO plan improvements.
21. [14-316] Approval of entrance onto public streets.
The road plan has been approved by VDOT per their approval letter dated 12/12/2019 &
forwarded by Chris Perez on 12/31/2019.
26. [147-303(G)] Ownership of Common Areas. On the plat label the ownership of the Forest & Open Space
Easement Area.
The following note has been added to the plat where it applies: "This SWM Forest &
Open Space Ease.Is Owned By The Bella Signature Homes Home Owners Assoc. And Runs
With The North Side Of The 100' Stream Buffer As It Meanders Along The Existing
Stream (6.72 Ac. Ref: Note 10)".
27. [14-302(A)2] Vicinity Map. Revise the vicinity map to depict the property and its relationship with adjoining
land and streets.
A scaled Tax Map has been used to depict the property and its relationship with
adjoining land and streets.
28. [14-317] Instrument evidencing maintenance of certain improvements. Prior to final subdivision plat approval
submitthe maintenance agreement ensuring the perpetual maintenance of the stormwater management facilities,
the open space areas, and any other improvements that are to be maintained by the HOA in perpetuity. County
Attorney approval is required prior to final subdivision plat approval.
Mr. Luke Kitelinger is having a deed of covenants, conditions, and restrictions
drafted to address facility and improvement maintenance.

2. This parcel is in Flood Zone X (outside the 0.2% chance annual flood plain) per Flood Fnsuranoe Rate Map Community -Panel 51003CO2801i for Albemarle
