Dear Ms. Saternye;
Re: Comments to be addressed with the Final Subdivision Plat Approval:
4. [14-302(A)(3)] Existing or platted streets. Revise the plat to specify the width of the existing prescriptive right of way
easement on the subject property, and the right of way width in front of the adjoining parcels, along Route 743.
UPDATE: Comment changed. Road was changed from private street to public street with a
resubmission prior to preliminary plat approval. Revise plat to specify the width of the proposed
public right of way dedication.
The right of way dedication was changed to 54' wide i.a.w. the public road design submitted by Timmons as noted on
Sheet 2 of the final plat.
6. 114-302(A)(13) & 14-3051 Proposed facilities; Stormwater management information. Revise the plat to show the
location of proposed drainage and stormwater related improvements. The proposed topography along the private street
does not appear to show drainage and does not appear to match those shown in private street request exhibits.
UPDATE: Comment partially addressed. A revised plat including stormwater management concept
was submitted and reviewed by engineering. Revise plat prior to final plat resubmission to address
engineering comments.
Stormwater management design was included on the public road plat submitted by Timmons. The dimensions around
their SWM facility and drainage easements are included on Sheets 3 & 4 of the final plat.
7. [14-302(A)(14) & 14-314] Land to be dedicated in fee or reserved; Identification of all interests of the County in
property. Revise the label for the area to be dedicated for Route 743 to include the wording "to be dedicated to the
County for public use." Also, revise note #10 to include the same wording.
The appropriate wording was included in Note 10 and at the required areas on the final plat.
8. [14302(A)(5) & 14-303(L)] Public easements; Public utility, drainage and sight distance easements.
Address the following:
a) ii a. Add a label to the proposed site distance easements that states "Dedicated to the Countyfor Public Use"
UPDATE: Comment partially addressed. Revise the label for the proposed public street to
include the wording "Dedicated to the County for Public Use".
The appropriate wording was included in Note io and at the required areas on the final plat.
b) Show any proposed drainage easements on plat and label them as either public or private. The drainage for the
private street appears to impact the adjoining lot.
UPDATE: Comment revised. Show the public drainage easements on the plat and submit the
proposed deed of easement for the drainage easements. Please note: A template for this deed will
be provided to you during the final plat review process.
Public drainage easement design was included on the public road plat submitted by Timmons. The dimensions around
their drainage easements are included on Sheets 3 & 4 of the final plat. The proposed deed of easement will be provided by
Mr. Kitelinger's attorney.
9. [14-303(D)] Acreage of lots. Revise plat as required to ensure acreage of proposed lots is correct. See engineering
comments.
Acreage has been double checked.
10. [14-303(E)] Dimension standards and information on all lots, streets, alleys, easements, and shared driveways.
Address the following:
a) Provide curve tables for curve data. Provided on Sheets 2 through 4 of the final plat.
b) Provide the boundary information for all sight distance easements. Provided on Sheet 3 of the final plat.
11. 114-303(0)&(P)1 Signature panels, Notary panels. If adjoining property owners will be signing plat (see above), in
order to approve sight distance easements on their property, then revise the plat include signature panels and notary
panels for those owners.
Signature and notary panels are included on Sheet 3 of the final plat.
12. [14-303(M)] Street names. Provide proposed street name for the proposed private street. Work with E911 reviewers
to ensure name meets street name criteria.
UPDATE: Comment partially addressed. The resubmitted plat has a street name proposed.
This street name must be approved by E911. That review will be done with the final plat.
However, the applicant can contact the E911 reviewer prior to final plat submittal to verify if
the name proposed would meet all the criteria.
The County's Road Name Index was checked prior to renaming the street Olivia Court subject to Egli review.
14. 114-303(H)1 Monuments. Revise the plat to clearly specify the monuments for the new lots are "to be set".
Irons have been set (or found) on all lot corners and around the public R/W for Olivia Court for the final plat.
15. [14-303(R)1 Parent parcel access. Provide the following note: `All subsequent division of the residue shall enter only
onto such street(s) shown on the approved final plat and shall have no immediate access onto to any public street. "
N/A - Olivia Court is a public street with all lot entrances designed and shown entering onto it. The parent tract has used
up its development rights (Ref: Note 3).
16. [14-303(S)1 Control points. Control points must be submitted. At the option of the subdivider, the control points may
be shown on a copy of the final plat, rather than on the original final plat.

18. 114-308.11 Groundwater assessment information. Final Tier 3 groundwater management plan must be approved prior
to approval of final plat.
Ernest Beasley<ebeasleyPhydrogeoenvironmental.com> submitted a Tier 3 Groundwater Assessment in Dec. 2018 to
John Anderson (c.c. Patricia Saternye) and received the following response:

Engineering accepted the draft Tier III Groundwater Assessment report on 12/13/2o18 and anticipated no change in
acceptance of a final report that repeats the draft report calculations.
19. [14-309 & 14-3101 Soil evaluations & Health director approval of well and septic systems.
Tom Hogge < tomhoggeohotmail.com> with Blue Ridge Soil Consulting, Inc. got a revised plat from me with surveyed
drainfields to turn into the Environmental Health Dept. on July 30, 2019. Note #6 on the final plat has been revised to
remove any reference to a possible relocation of the drainfield for Lot 5.
20. [14-311, 14-434 & 14-4351 Infrastructure improvement plans; Completion of on -site improvements required prior to
plat approval; Agreement and surety. Road Plan and WPO Plan must be approved, all required improvements must be
built or bonded, and all required Deeds and Declarations must be reviewed and approved prior to Final Plat approval.
Deeds for the subdivision declaration of covenants, conditions, and restrictions (covering dedication of utility easements,
SWM easements, public drainage easements, and the SWM forest & open space easement); the additional road right-of-
way dedication to the county; & VDOT sight easements will be provided by Mr. Kitelinger's attorney. Bonding for the road
and any other (Erosion & Sediment Control, SWM) improvements to be completed will be provided by Mr. Kitelinger.
21. [14-3161 Approval of entrance onto public streets. The subdivider shall submit, prior to or with the final plat, evidence
satisfactory to the agent that the entrance of the principal means of access for each lot onto any existing or proposed
public street complies with Virginia Department of Transportation standards.
Entrance design was included on the public road plat submitted by Timmons.
24. [Comment] The final plat will not be approved until the private street request has been approved, and the plat
matches what was approved, or the road has been changed to be a public road and VDOT has approved it.
UPDATE: Comment revised. The final plat will not be approved until the public road design and location
has been approved by VDOT, Fire Rescue and engineering. PLEASE NOTE: The first submittal of the plat was
reviewed by VDOT and Fire Rescue. That plat showed a private street and a different design at the end of the
proposed street. The revised plat, showing a public street has not been reviewed by VDOT and Fire Rescue.
Their review of the public version of the street will take place during the final plat review. The plat will not be
approved until VDOT, Fire Rescue and engineering approve the plat and the road design.
The Timmons Group has been responding to VDOT, Alb. County Engineering, and Fire Rescue for the past few weeks in
order to finalize their public road design and VSMP-WPO plan with facilities maintenance. They have recently completed
their work so that the subdivision plat can be submitted for final review.
26. [Comment] Attached find most of the comments from the other reviewers. Health Department comments
will be forwarded when they are available.
UPDATE: Comment revised. The VDH comment has been received and added to this updated
comments/conditions letter. Also, please note that all two engineering comments have been
included in this updated comment letter. That includes their comments for the revised version of
the plat and the comments for the draft groundwater assessment
The subsequent cover letter from the Alb. County Dept. of Community Development and attached engineering and VDH
comments touch on the following points:
- The VSMP-WPO plan needed to be fleshed out and approved as a separate submittal which was required prior to
final plat approval. Work is complete on that per the Timmons Group.
- Note 12 on the final plat states that critical slopes exist on Lots 3, 4, & 5•
- VDOT sight distance and other easements needed to be geometrically defined and included on a separate sheet.
This has been done on Sheets 3 & 4 on the final plat.

The final plat and the approved road plan must be consistent with each other. Culverts sized to pass a 25 year
storm event should be shown on the final plat. This has been done on Sheets 3 & 4 on the final plat.
Engineering Comments:
- The VSMP-WPO plan and a deed for dedication of SWM facilities and access including a maintenance agreement
between the owner and county should be prepared, then shown on the final plat. Work has been done on the
VSMP-WPO plan (which should outline access & maintenance) by the Timmons Group. We have shown the
easements on the final plat to be referenced and recorded simultaneously with the deed for dedication of SWM
facilities and access. An agreement to maintain SWM facilities and other techniques has been drawn up and
recorded by the County Attorneys' office on Oct. 29, 2019 in Inst. 201900011835•
- Engineering accepted the Tier 3 Groundwater Assessment from HydroGeo (Ernest Beasley).
Health Department Comments:
- The Health Dept. was waiting on the soils report and a final location for the DF on Lot 5. Tom Hogge <
tomhogge(&hotmail.com> with Blue Ridge Soil Consulting, Inc. got a revised plat with surveyed drainfields to turn
into the Environmental Health Dept. on July 30, 2oi9. Note #6 on the final plat has been revised to remove any
reference to a possible relocation of the drainfield for Lot 5.
CDD E911 Comments:
- CDD Egli was waiting on a road name. The County's Road Name Index was checked prior to renaming the street
Olivia Court subject to E911 review.
Fire Rescue Comments:
- Fire Rescue requirements prevent parking on the street, and the cul-de-sac ("T" turn around) should allow for
adequate emergency apparatus space to turn around. The Timmons Group has been responding to VDOT, Alb.
County Engineering, and Fire Rescue for the past few weeks in order to address their concerns and finalize their
public road design.
CDD Engineering Comments:
- These mostly address private road concerns. See above comment.
